(a) An abortion service shall be staffed so as to provide adequate medical, nursing and ancillary personnel on the premises.
(b) The abortion service shall be supervised by a physician in charge who shall be a qualified obstetrician as defined in Section 622.01.
(c) The physician in charge of the abortion service shall be responsible for:
(1) Setting the policies and procedures pertaining to abortions and the implementation thereof;
(2) Designating a licensed physician whom he or she deems qualified to perform abortions and to supervise directly the care of all patients undergoing abortion, including their postoperative care and follow-up; and
(3) Establishing standards for the observation of patients by nursing personnel during the postoperative period.
(d) A qualified obstetrician shall be present on the premises of the abortion service at all times during the operative and postoperative period.
(e) Whoever violates or fails to comply with any of the provisions of this section is guilty of a misdemeanor of the first degree. Punishment shall be as provided in Section 698.02.
