(a) An adequately sized and separate recovery room in proximity to the operating facilities shall be provided. A recovery room shall contain adequate monitoring equipment as well as suction, oxygen and other related equipment required for cardiac resuscitation, including a defibrillator. Such room shall be staffed by qualified nursing personnel. An adequate number of recovery beds and/or rooms shall be provided to ensure a minimum of three hours for the recovery of each patient.
(b) Whoever violates or fails to comply with this section is guilty of a misdemeanor of the first degree. Punishment shall be as provided in Section 698.02.
