406.06 CONSTRUCTION SITES; FLAGGER REQUIRED.
   The contractor in charge of a construction or work site on or in close proximity to a roadway or public right of way within the City at which equipment, vehicles, men, or materials are being transported across or are blocking or interfering with the movement of vehicular traffic on any portion of a roadway or public right of way, shall employ a flagger who shall warn approching traffic of such hazards and shall stop and direct traffic in the area so that the flow of vehicular traffic can be maintained in the safest possible manner. A flagger shall only be required at any time construction workers are on site performing work. Whoever violates this section is guilty of a first degree misdemeanor. Punishment shall be as provided in Section 408.01.
