ORDINANCE NO. O-18-2023
AN ORDINANCE ESTABLISHING MISCELLANEOUS ORDINANCE VIOLATIONS AND AMENDING TITLE 5 OF THE NORTHLAKE CITY CODE
   WHEREAS, the Cook County States Attorney has decided to decline to prosecute various misdemeanor offenses; and
   WHEREAS, the Mayor and City Council have determined that the aforesaid decision by the Cook County States Attorney is inimical to the public health, safety and welfare; and
   WHEREAS, the Mayor and City Council have determined that it is in the public interest to classify certain misdemeanors as violations of the Northlake City Code.
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and City Council of the City of Northlake, Cook County, Illinois, in the exercise of Northlake’s home rule powers as follows:
   SECTION 1:    The foregoing preambles are restated and incorporated herein by reference as though fully set forth herein.
   SECTION 2: Section 5-6-3-1 of the Northlake City Code is amended by re-lettering subsection J as subsection L.
   SECTION 3: Section 5-6-3-1 of the Northlake City Code is amended by adding the following as Section 5-6-3-1: Possession of Adult Use Cannabis in a Motor Vehicle – Prohibited:
1.   No driver may use cannabis within the passenger area of any motor vehicle upon a highway in the City of Northlake.
2.   No driver may possess cannabis within any area of any motor vehicle upon a highway in the City of Northlake except in a sealed, odor proof, child resistant container.
3.   No passenger may possess cannabis within any passenger area of any motor vehicle upon a highway in the City of Northlake except in a sealed, odor proof, child-resistant container.
SECTION 4: Title 5 of the Northlake City Code is amended by adding the following as Chapter 13 - Misdemeanor Offenses:
5-13-1 Sex Offenses:
There is hereby adopted by the City of Northlake and incorporated herein for the purpose of prohibiting certain sex offenses the following sections of the Illinois Criminal Code of 2012:
A.   720 ILCS 5/11-0.1 Definitions
B.   720 ILCS 5/11-14 Prostitution
C.   720 ILCS 5/11-14.1 Solicitation of a sexual act
D.   720 ILCS 5/11-14.3 Promoting prostitution
E.   720 ILCS 5/11-18 Patronizing a prostitute
5-13-2 Theft and Related Offenses:
There is hereby adopted by the City of Northlake and incorporated herein for the purpose of prohibiting theft and related offenses the following sections of the Illinois Criminal Code of 2012:
A.   720 ILCS 5/16-0.1 Definitions
B.   720 ILCS 5/16-1 Theft
C.   720 ILCS 5/16-2 Theft of lost or mislaid property
D.   720 ILCS 5/16-5 Theft from coin-operated machine
E.   720 ILCS 5/16-6 Theft – related device
F.   720 ILCS 5/16-14 Theft of utility services
G.   720 ILCS 5/16-25 Retail theft
 
5-13-3 Damage & Trespass to Property:
There is hereby adopted by the City of Northlake and incorporated herein for the purpose of prohibiting damage and trespass to property the following sections of the Illinois Criminal Code of 2012:
A.   720 ILCS 5/21-1 Criminal damage to property
B.   720 ILCS 5/21-1.01 Criminal damage to Government Supported Property
C.   720 ILCS 5/21-1.2 Institutional vandalism
D.   720 ILCS 5/21-3 Criminal defacement of property
E.   720 ILCS 5/21-1.4 Jack racks violation
5-13-4 Dog Fighting:
There is hereby adopted by the City of Northlake and incorporated herein for the purpose of prohibiting dog fighting, Section 48-1 of the Illinois Criminal Code of 2012 (720 ILCS 5/48.1).
5-13-99 Penalty
Any violation of this chapter shall be punishable by a fine of not less than five hundred dollars ($500.00) nor more than five thousand dollars ($5,000.00). Every day that a violation exists shall constitute a separate and distinct offense.
SECTION 5:   If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance.
   SECTION 6:   All ordinances in conflict herewith are hereby repealed to the extent of such conflict.
   SECTION 7:   This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
