ADOPTING ORDINANCE NO: O-04-067
AN ORDINANCE APPROVING, ADOPTING AND ENACTING THE CODIFIED ORDINANCES OF THE VILLAGE OF NORTH KINGSVILLE, EFFECTIVE AS OF JANUARY 1, 2005; REPEALING ORDINANCES IN CONFLICT THEREWITH; PUBLISHING THE ENACTMENT OF NEW MATTER; AND, TO DECLARE AN EMERGENCY.
WHEREAS, the daily operations of the Mayor’s department and the public peace, health and safety require the immediate adoption of this Ordinance;
WHEREAS, Council of the Village of North Kingsville has determined that it is necessary to complete a new codification and general revision of the ordinances before it;
WHEREAS, Council has heretofor entered into a contract with The Walter Drane Company to prepare and publish such codification; and,
WHEREAS, the codification of such ordinances, together with the new matter to be adopted, the matters to be amended and those to be repealed are before Council.
NOW, THEREFORE, BE IT ORDAINED, by Council for the Village of North Kingsville as follows:
Section One. The ordinances of the Village of North Kingsville, Ohio, of a general and permanent nature, as revised, codified, arranged and consolidated into component codes, titles, chapters, and sections, are hereby approved, adopted and enacted as the Codified Ordinances of North Kingsville, Ohio. A copy of the Codified Ordinances shall be certified as correct by the Mayor and the Clerk-Treasurer, attached to this Ordinance as a part hereof, and filed with the permanent ordinance records of the Village of North Kingsville, Ohio.
Section Two. All ordinances and resolutions or parts thereof enacted prior to November 1, 2004, which are in conflict or inconsistent with any provision of the 2005 Codified Ordinances are hereby repealed as of the effective date of this Ordinance, except as follows:
(a) The enactment of the 2005 Codified Ordinances shall not be construed to affect a right or liability accrued or incurred under any legislative provision prior to the effective date of such enactment, or an action or proceeding for the enforcement of such right or liability. Such enactment shall not be construed to relieve any person from punishment for an act committed in violation of any such legislative provision, nor to affect an indictment or prosecution therefor. For such purposes, any such legislative provision shall continue in full force notwithstanding its repeal for the purpose of revision and codification.
(b) The repeal provided above shall not affect:
(1) The grant or creation of a franchise, license, right, easement or privilege;
(2) The purchase, sale, lease or transfer of property;
(3) The appropriation or expenditure of money or promise or guarantee of payments;
(4) The assumption of any contract or obligations;
(5) The issuance and delivery of any bonds, obligations or other instruments of indebtedness;
(6) The levy or imposition of taxes, assessments or charges;
(7) The establishment, naming, vacating or grade level of any street or public way;
(8) The dedication of property or plat approvals;
(9) The annexation or detachment of territory; and
(10) Any legislation enacted subsequent to November 1, 2004.
Section Three. Sections and subsections of the 2005 Codified Ordinances without a legislative history or with the words quote “Adopting Ordinance” at the end thereof are or contain new matter ordained by this Adopting Ordinance.
Section Four. Pursuant to Ohio R.C. 731.25 and Section 113.01 of the Codified Ordinances, the Clerk-Treasurer shall post a copy of this Adopting Ordinance for a period of not less than 15 days in the five public places set forth in Section 113.01 of the Codified Ordinances. In addition, copies of the Codified Ordinances shall be available at the Village offices for inspection by the public.
Section Five. It is hereby found and determined that all meetings and deliberations of the Council for the Village of North Kingsville related to this Ordinance were conducted in compliance with Ohio R.C. 121.22.
Section Six. This Ordinance was passed at its first reading. For the reasons stated in the preamble and for the reason that the preservation of the safety and welfare of the residents of the Village of North Kingsville requires its passage, this Ordinance is declared to be an emergency measure, such emergency existing because of the need to have an up-to-date codification of the legislation of the Village, consistent with State law, with which to administer the affairs of the Village of North Kingsville, enforce law and order and avoid practical and legal entanglements. This Ordinance is declared to be an emergency measure and shall take effect on January 1, 2005.
