§ 156.089 APPLICATION ACCEPTANCE OR REFUSAL.
   (A)   Upon submittal of the minor subdivision plat, the Planning and Zoning Department shall check the plat submittal to ensure all data required has been provided. The submitted application and supplemental materials shall be forwarded to the Director of Planning and Zoning, or designee, and Public Works Director for review of correctness of form.
   (B)   Specifically, the Director of Planning and Zoning and Public Works Director shall refuse to process a minor subdivision plat if one or more of the following conditions are present:
      (1)   The proposed lots violate the city zoning or subdivision ordinance;
      (2)   The plat would require the vacation of any necessary easements;
      (3)   In the opinion of the Director of Planning and Zoning, the plat does not conform to the Comprehensive Plan or other plans for the area; and
      (4)   If any of the above conditions are found and the developer wishes to proceed to subdivide, the preliminary plat (§§ 156.040 through 156.050) and final plat procedures (§§ 156.060 through 156.070) shall be adhered to.
