§ 52.99 PENALTY.
   (A)    (1)   Any person or entity who violates § 52.02 shall, in addition to any remediation costs incurred by the town, be fined the following sums for the following offenses with each and every day the violation continues to be deemed a separate offense:
         (a)   First offense:      $500;
         (b)   Second offense:   $1,000;
         (c)   Third offense:      $1,500;
         (d)   Fourth offense:   $2,000;
         (e)   Fifth offense:      $2,500.
      (2)   In addition thereto, should the town be required to retain the services of an attorney to enforce this chapter, they shall be entitled to collect the attorney's fees as an additional penalty under this chapter.
   (B)   Any person who violates §§ 52.03 or 52.05 shall, on the issuance of a citation, be fined in a sum not exceeding $50 and each and every day the violation continues shall be taken to be a separate offense, which fine shall increase to $100 for each fine not paid within 7 days of violation issuance.
   (C)   Any person who violates § 52.04 shall, on conviction, be fined in a sum not exceeding $50.
   (D)   Every person issued a citation or violation of any provision of §§ 52.10 through 52.15 shall be fined a sum of $25 for each day a violation exists, which fine shall increase to $50 for each fine not paid within 7 days of violation issuance.
   (E)   Any violation of §§ 52.20 through 52.22 by any person shall be an infraction of law for which the penalty shall be $200 for each and every violation, which fine shall increase to $400 for each fine not paid within 7 days of violation issuance.
   (F)   Any violation of § 52.23 by any person, or entity, shall be fined in the amount of $250 for the first violation, $500 for the second violation, $1,000 for the third violation, and $2,500 for the fourth or any subsequent violation in addition to which, should the Town of New Palestine, Indiana, be required to retain the services of an attorney to enforce the provisions of this title and/or to collect any fine imposed, the violator shall, in addition to the fine, be required to pay any and all incurred attorneys' fees and associated expense.
