Permission may be granted to such persons as may desire to open up or remove any portion of any street surface, curb, gutter, sidewalk or area located between the sidewalk and gutter, provided that the consent of the Village Administrator is first obtained and the necessity of such work is established to his satisfaction. The Village Administrator shall adopt rules and regulations outlining the requirements for obtaining a permit. A permit fee of twenty-five dollars ($25.00) shall be collected by the Fiscal Officer for such permit, and the applicant shall deposit moneys or a suitable bond simultaneously with the issuance of such permit as a guarantee that the street surface, curb, gutter, sidewalk or area located between the sidewalk and the gutter shall be satisfactorily restored, such deposit or bond being deposited with the Fiscal Officer in a sum of money as set forth in rules and regulations adopted by the Village Administrator.

All street surfaces, curbs, gutters, sidewalks or area located between the sidewalk and the gutter opened up, removed or damaged shall be replaced and repaired by such permittee under supervision of any to the satisfaction of the Village Administrator. The Village Administrator shall adopt rules and regulations outlining the requirements for all work to be performed by permittees in replacing and repairing Village streets and rights of way. Upon completion of the work, the permittee shall notify the Village Administrator of the fact of its completion and he shall make a final inspection thereof. If such inspection is to the satisfaction of the Village Administrator, he shall so notify the permittee and also the Fiscal Officer, who shall thereupon return the guarantee deposit or release the bond. If the inspection discloses a defect or unsatisfactory work that is unacceptable to the Village Administrator, he shall notify the licensee of such defect or condition and the licensee shall have ten days in which to rectify the same or forfeit the guarantee deposit or bond, and the Village shall thereupon complete the repair or replacement at the cost and expense of the permittee. If the permittee is the owner of the property adjacent to the street, curb, gutter, sidewalk or right of way for which the excavation permit was issued, and if such permittee fails to reimburse the Village within thirty days after the mailing of a notice of the costs for the repair or replacement, such amount shall be certified to the County Auditor for collection of the same as other taxes and assessments are collected.

Every person in this Village who digs or causes to be dug in or adjoining any of the public ways of the Village any excavation whatsoever and every person who occupies or causes to be occupied any portion of any public street with building material or any obstruction, shall cause sufficient red lights to be securely and conspicuously placed in or near such excavation, building material or obstruction, one at each end of the space so excavated or occupied.
