§ 35.610 MILITARY LEAVE.
   All regular, full-time employees who leave the village's employ to join the active military forces of the United States during time of war or other national emergency, or who is drafted into the military service at any time, shall be granted a military leave without pay. Such leave will extend through a date 90 days after he or she is released from service. Proof of service must be filed with the Municipal Manager. Such employee shall be restored to the position vacated or to a comparable position occupied at the time leave is granted, provided that the employee submits an application to the Municipal Manager within 90 days after release, and is physically and mentally capable of performing the work of the former position. Failure of an employee to notify the village of his or her intent to return to work within 90 days of release shall be considered a resignation of employment.
