For the use of service rendered by the water works system of the town to industrial users based upon the use of water supplied requiring special treatment beyond that furnished for residential, commercial and institutional customers:
(A) Basic metered rates per month: Effective on the first full billing after adoption of Ord. 1340, the combined billing of I/N Tek and I/N Kote monthly billing shall be:
(1) Zero to 15 million gallons (minimum): as set forth in the Fee Schedule, Chapter 98; and
(2) Over 15 million gallons: as set forth in the Fee Schedule, Chapter 98, per 1,000 gallons.
(B) The minimum monthly charge as set forth in the Fee Schedule, Chapter 98 shall be divided as follows:
(1) I/N Tek: as set forth in the Fee Schedule, Chapter 98; and
(2) I/N Kote: as set forth in the Fee Schedule, Chapter 98.
(C) Effective upon the date of transfer of the water plant to provide water to the St. Joseph Energy Center to the town, the St. Joseph Energy Center LLC monthly billing shall be:
(1) Base rate per month (minimum): as set forth in the Fee Schedule,
Chapter 98
; plus
(2) Metered rate: as set forth in the Fee Schedule,
Chapter 98

(D) The initial base rate will be adjusted annually as of June 1, 2019, 2020, 2021 and 2022 (the 12-month periods from June 1 of one year through May 31 of the following year) based on the increase in the CPI (as defined below) from the initial base year.
(E) Before May 31, 2023, a new base rate (the "new base rate") will established for the following year (the "new base year"), to allow for recovery of the town's average annual costs of ownership and operation of the Wells and Water Plant based on actual costs incurred over the preceding 5 years, together with known costs to be incurred because of regulatory and environmental conditions and regulations. The new base rate will be subject to adjustment annually during the next 4 years based on the increase in the CPI from the new base year.
(F) The foregoing process will be repeated every 5 years during the period when St. Joseph Energy Center is receiving water from the town. As used herein, "CPI" means the Consumer Price Index for all urban consumers (CPI-U), U.S. city average, published by the Bureau of Labor Statistics of the United States Department of Labor, and the CPI to be used will be the one published most recently prior to the date in question.
