§ 52.41 SCHEDULE OF RATES AND CHARGES FOR INDUSTRIAL WATER USERS.
   For the use of service rendered by the waterworks system of the town to industrial users based upon the use of water supplied requiring special treatment beyond that furnished for residential, commercial, and institutional users:
   (A)   The combined billing of Cleveland Cliffs (Tek) and Cleveland Cliffs (Kote) monthly billing shall be as set out in Ch. 98.
   (B)   The minimum monthly charge shall be as set out in Ch. 98.
   (C)   The St. Joseph Energy Center LLC monthly billing shall be as set out in Ch. 98.
   (D)   The initial base rate will be adjusted annually as of June 1, 2019, 2020, 2021 and 2022 (the 12-month periods from June 1 of one year through May 31 of the following year) based on the increase in the CPI (as defined below) from the initial base year.
   (E)   Before May 31, 2023, a new base rate (the “new base rate”) will be established for the following year (the “new base year”), to allow for the recovery of the town’s average annual costs of ownership and operation of the Wells and Water Plant based on actual costs incurred over the preceding 5 years, together with known costs to be incurred because of regulatory and environmental conditions and regulations. The new base rate will be subject to adjustment annually during the next 4 years based on the increase in the CPI from the new base year.
   (F)   The foregoing process will be repeated every 5 years during the period when St. Joseph Energy Center is receiving water from the town. As used herein, “CPI” means the Consumer Price Index for all urban consumers (CPI-U), U.S. city average, published by the Bureau of Labor Statistics of the United States Department of Labor, and the CPI to be used will be the one published most recently prior to the date in question.
