339.17 PROHIBITION ON THROUGH TRUCK TRAFFIC ON WASHINGTON PARK BOULEVARD.
   (a)   All through truck traffic, trailer traffic and semi-trailer traffic shall be prohibited on Washington Park Boulevard, except as otherwise set forth herein, and it shall be unlawful for any person, partnership, corporation, company, firm or other business entity to operate any truck, trailer, semi-trailer, or tractor on Washington Park Boulevard.
   (b)   This section shall not apply to any of the following:
      (1)   Any vehicle used for carrying mail by the United States of America;
      (2)   Any Village of Newburgh Heights vehicle used for municipal purposes;
      (3)   Any truck, trailer, semi-trailer or tractor the contents of which are loaded or unloaded, in whole or in part, at a place of business, school, industry or residence within the Village.
      (4)   Any pick-up truck.
   (c)   This section may be enforced under the Village's automated traffic enforcement program established under Codified Ordinances Chapter 315 . The term "notice of liability," as used in Chapter 315 of the Village's Codified Ordinances, shall also refer to a violation of this Section 339.17 . Fines and procedures shall be identical to those established in Codified Ordinances Chapter 315 . Any cameras or other equipment utilized to enforce this Section 339.17 shall not require calibration, since speed limit violations are not at issue for purposes of this section.
   (d)   Any violator of the prohibitions set forth in this section shall be held strictly liable.
