§ 157.138 C3 NEIGHBORHOOD COMMERCIAL DISTRICT.
   (A)   Purpose statement. This district is intended to accommodate small scale retail establishments to service residential neighborhoods. These activities may be either in freestanding structures or a part of a planned retail center which contains less than 30,000 gross square feet. The C3 District is intended for the safety and convenience of residents in the immediate vicinity of the center without adversely impacting the quality of residential life in the areas immediately adjacent to the center.
   (B)   General provisions. All developments for a C3 shall be subject to the following general provisions.
      (1)   All applications for a C3 improvement location permit shall be reviewed and acted upon by the Plan Commission after a review and report by the Site Review Advisory Committee.
      (2)   Drive-in type establishments offering goods and services directly to customers waiting in parked motor vehicles are not permitted unless specially authorized.
      (3)   All exterior lighting shall be directed away from adjoining residential property and shall be of an intensity so as not to interfere with the enjoyment of adjacent residential property.
      (4)   Accommodate pedestrian access to the maximum possible extent.
   (C)   Permitted uses. The following uses are permitted in the C3 District:
      (1)   Art and school supply stores;
      (2)   Bakery, and other food shops preparing food for consumption off-premises but not for the consumption in vehicles;
      (3)   Banks and other financial institutions without drive-through facilities but with automatic teller machines;
      (4)   Barber, beauty shops, hair styling salon;
      (5)   Bicycle shops, sales/services;
      (6)   Bookstores/stationary stores;
      (7)   Camera and photography shops;
      (8)   Day care facilities;
      (9)   Delicatessen stores without liquor;
      (10)   Drug stores;
      (11)   Dry cleaning/laundry pick-up facilities;
      (12)   Florists;
      (13)   Funeral homes;
      (14)   Grocery/convenience marts without gasoline pumps;
      (15)   Hardware stores/paint and wallpaper;
      (16)   Newsstands;
      (17)   Professional offices for attorneys, doctors, accountants, architects, insurance, real estate, stock and commodities brokers and other similar professional services;
      (18)   Restaurants with the following characteristics: no drive-in or drive-through service is provided; and seating and table services is provided to patrons;
      (19)   Shoe repair shops;
      (20)   Single-household residences;
      (21)   Small appliance repair shops;
      (22)   Studio for art, music, dance, photography and the like;
      (23)   Tailor and alterations;
      (24)   Video rental;
      (25)   Banquet hall, reception hall, conference center, event facility;
      (26)    Other similar activities determined by the Administrator to be substantially similar to the permitted uses and which serve a non-business clientele in the immediate neighborhood; and
      (27)   Bar, tavern, lounge.
   (D)   Conditional uses. The following conditional uses may be permitted in the C3 District:
      (1)   Conditional uses which may be permitted in residence districts: RL, R1, R2, R3 and R4;
      (2)   Convenience marts with gasoline pumps;
      (3)   Libraries, galleries, art centers and other similar uses including associated education institutions;
      (4)   Lodges and fraternal organizations; and
      (5)   Residential dwelling units at a density of less than six units per acre.
   (E)   Development area and width. There are no minimum lot area or width requirements in the C3 District. The maximum buildable lot shall not exceed one and one-half acres.
   (F)   Yards. The yard requirements in the C3 District are as follows:

   (G)   Building height. No building in a C3 District shall exceed a height of 35 feet or the height of adjacent residential structure whichever is less.
   (H)   Off-street parking and loading. The parking and loading requirements for the C3 District shall be specified in §§ 157.181 and 157.182.
   (I)   Landscaping and screening. The landscaping and screening requirements for the C3 District shall be specified in § 157.065.
   (J)   Sign regulations. The sign regulations for the C3 District shall be as specified in §§ 157.195 through 157.218 .
   (K)   Site plan acceptance. In accordance with § 157.039.
