(A) Purpose statement.
(1) This district is intended to create a unique downtown environment for the central business area of the town, that has design features and a diversity of uses not found in the other commercial districts in the town.
(2) This district provides for institutional users customarily found in downtown areas including government buildings, cultural facilities, schools and also provides for a mixture of small scale business activity oriented toward visitors, office and business support services and residences, and ancillary uses.
(B) General requirements. All developments in the C1 District shall be subject to the following general requirements.
(1) All applications for an improvement location permit in the C1 District shall be reviewed and recommended for approval or denial by the Plan Commission after a development review and report by the Site Review Advisory Committee as set forth in § 157.039 (Site Review Advisory Committee).
(2) “Drive-in” type establishments offering goods or services directly to customers waiting in parked motor vehicles are not permitted unless specifically authorized herein.
(3) Only commercial uses, as specified below, are permitted beneath the second floor.
(C) Permitted uses. The following uses are permitted in the C1 District:
(1) Accessory uses;
(2) Antique shops and galleries;
(3) Art gallery and artist studio;
(4) Barber shops;
(5) Beauty shops;
(6) Broadcast media studio (no tower);
(7) Churches, temples, synagogues;
(8) Computer services;
(9) Copying shops and quick print shops;
(10) Cultural facilities;
(11) Design studios;
(12) Detective agency, no dogs;
(13) Financial institutions without drive-up window;
(14) Florist;
(15) Bed and breakfast inns;
(16) Libraries;
(17) Medical and dental lab;
(18) Membership organization: meeting hall, refreshments;
(19) Residences above first floor;
(20) Museums;
(21) Offices, business, government, professional;
(22) Offices, medical, dental;
(23) Photo studio;
(24) Repairs: household, personal goods;
(25) Restaurants without drive-up window;
(26) Retail: apparel and accessory;
(27) Retail: bakery, butcher, fruits, vegetables;
(28) Schools: correspondence, professional, business;
(29) Schools: dance, art, music, business;
(30) Shoe repair and shine shops;
(31) Social services, individual and family;
(32) Tailors;
(33) Banquet hall, reception hall, conference center, event facility; and
(34) Bar, tavern, lounge.
(D) Conditional uses. The following conditional uses may be permitted in the C1 District:
(1) Public parking lot, or garage;
(2) Pet shops;
(3) Physical education center, all inside;
(4) Public safety buildings;
(5) Retail; furniture, appliances;
(6) Retail; general merchandise; and
(7) Beer garden.
(E) Development area and width. There are no minimum lot area or width requirements for the C1 District.
(F) Yards. The yard requirements in the C1 District:

(G) Building height. No building in the C1 District shall exceed a height, at the property line, of 45 feet.
(I) Landscaping and screening. The landscaping and screening requirements for the C1 District shall be as specified in § 157.065.
