(A) Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(B) (1) Any person that has violated or continues to violate §§ 153.01 through 153.16 and has received notice of such violation shall be subject to a fine of up to $2,500 per violation per day, at the discretion of the Board. In the event the fine is not paid, the ordinance violation may be filed in court and the owner of the property or the violator, upon a finding of liability, shall be guilty of an ordinance violation and shall be responsible for the fine, court costs and other expenses associated with enforcement of §§ 153.01 through 153.16, including sampling and monitoring expenses.
(3) All fines collected by the town under this division (B) shall be deposited in the Storm Water Management Fund.
