(A) (1) There shall be collected a fee of $100 per hour, with a minimum fee based upon three hours, for any person, firm or corporation, other than the town or its agencies, for the use of the Newburgh Trolley.
(2) Waiver of such fee may only be approved by the Town Council and such approval shall be the exception and not the rule.
(B) The Trolley:
(1) Must be used within the town or within a 15 mile radius outside the corporate limits of the town;
(2) May be used outside the corporate limits of the town only if the purpose for such use is to promote the town community or an event in the town;
(3) Must be operated by a driver selected by the renter from an approved list of drivers maintained by the town;
(4) The driver shall be paid by the renter;
(5) Must be returned to the Town Hall parking lot at the completion of its use in the same condition as it was when picked up by the renter;
(6) Shall not be used for any illegal purpose;
(7) Shall not carry more people than the vehicle is rated for; and
(8) Shall be returned with a full tank of fuel.
(C) (1) All requests for rental of the Trolley shall be made in writing to the Town Administrative Manager at least one week before the Town Council meeting at which such request shall be heard.
(2) The written request must acknowledge acceptance of the conditions for Trolley use and, in the case of a proposed use of the Trolley outside the corporate limits of the town, shall describe the purpose for such use and how such use will promote the town community or an event in the town.
