For the violation of any of the following provisions of this chapter and after reasonable notice in writing to the Company, penalties shall be chargeable to funds available through the Letter of Credit as follows:
(a) For failure to complete system construction and provide service in accordance with the service contract, unless Council specifically approves the delay by motion or resolution, due to the occurrence of conditions beyond the Company's control, the Company shall pay two hundred dollars ($200.00) per day for each day, or part thereof, the deficiency continues.
(c) For failure to test, analyze and report on the performance of the system following a request pursuant to Section 737.36, the Company shall pay fifty dollars ($50.00) per day for each day, or part thereof, that such noncompliance continues.
(d) For failure to comply with the operational standards following Council's ordinance directing the Company to make improvements pursuant to Section 737.24, the Company shall forfeit fifty dollars ($50.00) per day or part thereof that the violation continues.
(e) For any other violation of this chapter for which a penalty is not specifically provided, the Company shall forfeit fifty dollars ($50.00) per day each day such violation occurs or continues.
