737.36 PERFORMANCE EVALUATION SESSIONS.
   (a)    The Village and the Company shall hold scheduled performance evaluation sessions within thirty days of every anniversary date of the Company's acceptance of the service contract or as may be required by federal and state law. All such evaluation sessions shall be open to the public.
 
   (b)    Special evaluation sessions may be held at any time during the term of the contract at the request of the Village or the Company.
 
   (c)    All evaluation sessions shall be open to the public and announced in a newspaper of general circulation in accordance with rules for notice of meetings to be adopted by the Council. Company shall notify its subscribers of all evaluation sessions by announcement on at least two local origination channels of its system between the hours of 7:00 p.m. and 9:00 p.m., for five consecutive days preceding each sessions.
 
   (d)    Topics which may be discussed at any scheduled or special evaluation session may include, but not be limited to, service rate structures; contract fee; penalties; free or discounted services; application of new technologies; system performance; services provided; programming offered; customer complaints; privacy; amendment to this chapter; judicial and FCC rulings; line extension policies; and Company or Village rules.
 
   (e)    Members of the general public may add topics by requesting of the Village that such topics be added to the agenda of its meeting.
 
   (f)    During a review and evaluation by the Village, the Company shall fully cooperate with the Village and shall provide such information and documents as the Village may need to reasonably perform the review.
 
   (g)    If at any time during its review, the Village determines that reasonable evidence exists of inadequate cable system performance, it may require the Company to perform tests and analysis directed toward such suspected inadequacies. The Company shall fully cooperate with the Village in performing such testing and shall prepare results and a report, if requested, within thirty days after notice. Such report shall include the following information:
      (1)    The nature of the complaint or problem which precipitated the special tests.
      (2)    What system component was tested.
      (3)    The equipment used and procedures employed in testing.
      (4)    The method, if any, in which such complaint or problem was resolved.
      (5)    Any other information pertinent to the tests and analysis which may be required.
   (h)    The Village may require that tests be supervised, at the Company's expense, by a professional engineer selected by the Village not on the permanent staff of the Company. The engineer should sign all records of special tests and forward to the Village such records with a report interpreting the results of the tests and recommending actions to be taken.
