§ 70.99 PENALTY.

   (A)   A person who violates any provision of this title for which another penalty has not been provided shall be fined a minimum of $5 and not more than the maximum of $500.

   (B)   The Judge of the County Court is authorized to waive any minimum fee or penalty provided in this chapter if, in his or her discretion, the Judge believes the waiver to be fair and in the interests of justice.

   (C)   Any person found in violation of § 71.07 shall be subject to a fine of not less than $1, nor more than $25.

   (D)   A violation of § 71.25 shall be subject to a fine of no more than $500 for a first offense and no more than $1,000 for each subsequent offense.

   (E)   Speeding fines.

      (1)   Any violation of § 71.45 shall be subject to the following fines:

1 - 15	$25 plus court costs (as set and amended by the Courts and the State of Indiana
15 - 20	$50 plus court costs (as set and amended by the Courts and the State of Indiana)
21 - 25	$75 plus court costs (as set and amended by the Courts and the State of Indiana)
Over 25	$100 plus court costs (as set and amended by the Courts and the State of Indiana)

 

      (2)   Any conviction associated with the above-referenced sections shall be reported to the Indiana Bureau of Motor Vehicles.

      (3)   All fees and charges collected under the provisions set forth, except when the same have been paid into the court, shall be deposited in the non-reverting fund.

   (F)   Moving violation fines.

      (1)   Any violation of § 71.20 (Failure to Obey Signs) and § 71.21 (Failure to Obey Traffic Signals) shall be subject to the following fines: $50 plus court costs as set and amended by the State of Indiana and the Courts.

      (2)   Any conviction associated with the above-referenced sections shall be reported to the Indiana Bureau of Motor Vehicles.

      (3)   All fees and charges collected under the provisions set forth, except when the same have been paid into the court, shall be deposited in the non-reverting fund.

   (G)   City Attorney/Municipal Diversion Program.

      (1)   The fees and costs associated with the Municipal Diversion Program shall be as follows:

 

Initial User Fee	$50
Monthly User Fee	$10
Plus:	Court costs as set and amended by the State of Indiana and the Courts

 

      (2)   All fees and charges collected under the provisions set forth, except when the same have been paid into the court, shall be deposited in the non-reverting fund.
