PERSON: Any individual, partnership, co-partnership, firm, company, limited liability company, corporation, association, joint stock company, trust, estate, political subdivision (including the City of Nauvoo), or any other legal entity, and his/her/its legal representatives, agents, or assigns.
POTABLE WATER: Any water used for human or domestic consumption, including, but not limited to, water used for drinking, bathing, swimming, washing dishes, or preparing foods. (Ord. 2017-9, 9-12-2017)
Except for such uses or methods in existence before the effective date of this chapter, the use or attempted use of groundwater as a potable water supply (such as by installing or drilling wells or otherwise accessing groundwater) by any person, including the City of Nauvoo, is strictly prohibited within the following designated area:
The area bordered by Knight Street, N. Fulmer Street, Ripley Street, and N. Wilcox Street, as they are currently configured. (Ord. 2017-9, 9-12-2017)
Any person who violates the provisions of section 5-3-2 of this chapter shall be subject to a fine of up to seven hundred fifty dollars ($750.00) for each offense and shall pay all enforcement and/or collection costs and expenses, including court costs and legal fees. Each day that a violation exists or continues shall be considered a separate offense. (Ord. 2017-9, 9-12-2017)
