5-2-3: ABATEMENT BY CITY:
If the owner and occupant fail to abate the public nuisance within the time period provided for in the notice, or as extended by the City, then the City, by its employee, agent, or other designee, is authorized to enter upon the property upon which the public nuisance exists and abate the nuisance, including spraying, cutting, or otherwise removing the public nuisance and performing any related clean-up and removal. If the public nuisance should recur on that property within a 12-month period, the City, or its employee, agent or other designee, is authorized to take the action described in this section without the necessity of additional notice to the owner and occupant.
