§ 151.018 PRELIMINARY PLAT.
   (A)   Checking and acceptance of construction plans required. The Planning Commission shall forward two copies of the preliminary plat to the Municipal Engineer and the County Zoning Administrator and County Engineer, if applicable, for checking of matters within their jurisdiction and acceptance of the construction plans for required proposed improvements proposed to be installed.

   (B)    Notice of acceptance.
      (1)   The Planning Commission, upon receipt of recommendations from the Municipal Engineer and the County Zoning Administrator and County Engineer, if applicable, concerning matters indicated in § 151.017, shall accept or not accept the preliminary plat and plans and specifications for required improvements within 90 days of receipt thereof.
      (2)   If accepted, the Commission will recommend acceptance of the preliminary plat and plans and specifications for required improvements by the municipality within 30 days of its next regular stated meeting following action of the Planning Commission.
      (3)   Acceptance of the preliminary plat and plans and specifications for required improvements will authorize the subdivider/developer to proceed with the proposed improvements in accordance with the provisions of this subchapter and the minimum design standards. The Commission shall return one copy of the preliminary plat to the sub divider/developer with the date of acceptance. A similar copy also will be transmitted by the Commission to the Municipal Engineer and the County Zoning Administrator and County Engineer, if applicable.
      (4)   If the preliminary plat is not accepted by the Commission, the subdivider/developer must be furnished with a letter stating the reason for nonacceptance.

   (C)   Acceptance; permit for improvements; surety bond. The subdivider, after the acceptance of the preliminary plat, may:
      (1)   Secure from the municipality the necessary permits to proceed with the required improvements; or in lieu of this; or
      (2)   (a)   Post with the Commission a surety bond, in form prescribed by the Commission, sufficient to cover the full cost of improvements based upon estimate accepted by the Municipal Engineer.
         (b)   This will ensure the satisfactory installation of required improvements in accordance with the provisions of this subchapter and the minimum design standards.
