195.15 RULE 15 WAIVER OF RULES.
In specific cases where, in the judgment of the commission, it is in the best interest of the public service, any Rule may be waived or suspended by a majority vote of the commission. In addition, any Rule requested by an officer or employee and concurred in by the appointing authority may be waived or suspended by the commission, if it determines that it is in the best interest of the public service; however, the city council has the ultimate authority to prohibit the waiving or suspending of any Rule by the commission and expressly prohibits the waiving or suspending by the commission of Rule 9.5.2 (Promotion Or Appointment Of A Chief Within The Police Or Within The Fire/Rescue Department), Rule 12 (Political Activity Prohibited) and Rule 13 (Reductions, Suspensions And Dismissal) and this Rule 15 (Waiver Of Rules).
