§ 33.66 CITY COUNCIL DETERMINATION AFTER PUBLIC HEARING.
   (A)   Upon a determination that the claim will be decided with a public hearing, pursuant to §§ 33.64 or 33.65, the City Manager shall set the date for the public hearing and shall promptly provide the notice required by ORS 195.314(1).
   (B)   Upon conclusion of the public hearing and prior to the expiration of 180 days from the date the claim was deemed complete, the City Council shall:
      (1)   Determine that the claim does not meet the requirements of ORS 195.300 through 195.336 and this subchapter and deny the claim; or
      (2)   Adopt a resolution with findings therein that supports a determination that the claim is valid and awarding relief as provided in ORS 195.310(4).
   (C)   The City Council’s choice of relief awarded pursuant to ORS 195.310(4), shall be based on whether the public interest would be better served by compensating the owner or by waiving the challenged land use regulation with respect to the subject property.
