(A) Following an initial review and investigation of a complete claim, the City Manager shall forward a recommendation to the City Council that the claim be:
(1) Denied;
(2) Investigated further;
(3) Declared valid, and waive or modify the land use regulation, or compensate the claimant upon completion of an appraisal; or
(4) Evaluated with the expectation of the city acquiring the property by condemnation.
(B) If the City Manager’s recommendation is that a claim be denied, then the City Manager may proceed without a public hearing, as provided in § 33.65, unless two or more members of the City Council notify the City Manager within 14 days that they want a public hearing on the matter, as provided in § 33.66.
(C) If the City Manager’s recommendation is for anything other than a denial, the matter shall be scheduled for a public hearing, as set forth in § 33.66.
