(A) Upon a determination that the claim will be decided without a public hearing, pursuant to § 33.64(B), the City Manager shall establish a deadline for the receipt of written comments and shall promptly provide the notice required by ORS 195.314(1).
(B) After the deadline for written comments has expired, the City Manager shall review the comments and:
(1) If the City Manager’s recommendation remains that the claim should be denied, the City Manager shall issue written notice of the city’s final determination of denial, pursuant to ORS 195.314(6); and
(2) If the City Manager’s recommendation is for anything other than denial, the matter shall be scheduled for a public hearing, as set forth in § 33.66.
