12.32.070: CITY PROPERTY TREES; FORESTRY DIVISION RESPONSIBILITIES:
   A.   Trees and other plants growing in a City park or in the cemetery are under the jurisdiction of the Parks and Recreation Department.
   B.   The City Forester is responsible for abating or correcting the following conditions associated with trees growing in tree planting strips, City parks, or other City property:
      1.   Removal of dead or living trees or limbs that are determined by the City Forester to be a hazard to public safety and property;
      2.   Removal of trees or limbs that have actually fallen across a street, sidewalk, or other City property;
      3.   Removal of dead trees, and damaged, diseased, or insect infested trees which are determined by the City Forester to be beyond rehabilitation;
      4.   Removal of trees, limbs or roots causing damage to City property, or which are directly inhibiting street widening projects, new sidewalk, curb and gutter repairs;
      5.   Removal of trees, limbs, or roots that are determined by the City Forester to be:
         a.   A nuisance, such as by obstructing or interfering with water or sewer lines, irrigation ditches, street lighting or power lines;
         b.   Impairing good visibility along streets or at intersections;
         c.   Obstructing clear passage of vehicular and/or pedestrian traffic;
         d.   Requiring pruning to train the growth pattern;
         e.   Too closely spaced; and/or
         f.   An unsuitable street tree species, in accordance with the adopted arboricultural regulations;
      6.   Removal of trees, limbs, or roots in other circumstances if the City Forester determines that the work will benefit the City or the public interest. (Ord. 18-06: Ord. 17-30)
