§ 52.100 SUPPLEMENTAL REGULATIONS.
   (A)   New sources.
      (1)   Categorical standards are based on existing source industries and new source industries. The term "new source" shall mean any building, structure, facility or installation from which there is or may be a discharge of pollutants, the construction of which commence after the publication of proposed pretreatment standards provided that:
         (a)   The building, structure or facility or installation is constructed at a site which no other source is located; or
         (b)   It totally replaces the process or production equipment that causes the discharge of pollutants at an existing source; or
         (c)   The production or wastewater generating processes are substantially independent of an existing source at the same site.
      (2)   New sources shall install and have in operating condition and shall "start-up" all pollution control equipment required to meet applicable pretreatment standards before beginning to discharge. Within the shortest feasible time (not to exceed 90 days), new sources must meet all applicable pretreatment standards.
         (a)   All discharge limits calculated under 40 CFR 403.6 (c) (304) must be complied with by all industrial users subject to production based standards.
         (b)   Each industrial user shall report to the pretreatment coordinator production rates annually.
   (B)   Conversion of mass limits to concentration limits. When the limits in a categorical pretreatment standard are expressed only in terms of mass of pollutant per unit of production, the city may convert the limits to equivalent limitations expressed as effluent concentration limits.
   (C)   Dilution. Except where expressly authorized, no industrial user shall ever increase the use of process water, or in any other way attempt to dilute a discharge as a substitute for adequate treatment to achieve compliance.
   (D)   Monitoring combined water streams. Where a treated regulated process wastestream is combined prior to treatment with wastestreams not regulated, the industrial user may monitor either the segregated wastestream, or the combined wastestreams using the combined wastestream formula. The industrial user may change monitoring points only with prior approval from the city and not for purposes of dilution in order to achieve compliance.
   (E)   Violation notification. If sampling performed by an industrial user indicates a violation, the user shall notify the city within 24 hours. The user shall repeat the sampling and analysis and submit the results to the city within 30 days after becoming aware of the violation. Exception to this regulation is only if the city performs sampling within the same time period for the same pollutant in question.
