(A) In a development where sewers are not constructed by the developer and the sewer is to be installed and supplied by the City of Murray, the developer shall place a perpetual restrictive covenant agreeing to annexation in the covenants and restrictions of the subdivision and shall attach such restrictive covenant to each deed of any property sold. Such deed with the restrictive covenant attached shall be filed with the Clerk of Calloway County.
(B) If a property owner who lives outside Murray City limits on property contiguous to Murray City limit boundaries, or outside the Murray City limits but within the four (4) mile radius urban service area, requests sewer service, the property owner must agree to be annexed and must sign a waiver of opposition to annexation to be placed with the deed to his or her property, prior to any service being considered.
(C) In those instances where sewer service is being transferred by name to another customer and the residence or business is outside the city limits, served by city sewer and within the four-mile radius, the new sewer customer must agree to be annexed and shall be required to sign the waiver of annexation form to be placed with his or her deed to the property as well.
(D) New customers outside the city limits but within the four (4) mile limit whose property is not contiguous to the city limits and not in an approved subdivision shall be required to sign a perpetual restrictive covenant agreeing to annexation and file it with the deed to the property in order to connect to already existing sewer service. In addition, each landowner shall secure all adjoining landowners' easements for utility services when the utility service must cross over other landowners' properties.
(E) Every property owner who may be eligible for City of Murray Water and Sewer Services must sign a waiver of opposition to annexation and must affirmatively agree, in a legal writing, to be annexed, with such agreement to be placed with the deed to the property in the Calloway County Clerk's Office.
