§ 52.60 RATES, CHARGES, AND FEES.
   This chapter provides for the recovery of costs from users of the POTW for the implementation of the programs established herein.
   (A)   The city may adopt charges and fees for operating the water resource recovery facility and sewage treatment programs provided to the public. In addition, the city may adopt charges for services which include, but are not limited to:
      (1)   Fees for reimbursement of costs of setting up and operating the pretreatment program of the city;
      (2)   Fees for reimbursement of costs of setting up and operating the fats, oils and grease program of the city;
      (3)   Fees for constructing, extending, maintaining and repairing the Murray Sewer System;
      (4)   Fees for monitoring, inspection and surveillance procedures;
      (5)   Fees for reviewing accidental discharge procedures and construction;
      (6)   Fees for filing appeals;
      (7)   Fees for permit applications;
      (8)   Fees for consistent removal by the Murray Sewer System of pollutants otherwise subject to federal pretreatment standards; and
      (9)   Other fees as the city may deem necessary to carry out the requirements contained herein.
   (B)   These fees relate solely to the matters covered by this chapter and are separate from all other fees chargeable by the city. All fees and charges not specifically established will be set by the city and will be based on the annual review of the cost incurred by the city to carry out the requirements contained herein.
   (C)   Definition of charges.
      (1)   Debt service charges means the annual charges levied on the users of the sewage treatment system (water resource recovery facility) to support the annual debt service obligations of the system.
      (2)   Excessive strength surcharges means charges levied on all wastewater users of the sewage treatment system (water resource recovery facility) whose wastewater contribution contains biological oxygen demand (BOD)s, suspended solids (SS), total phosphorus, and/or total oils and grease (O & G) in concentrations which exceed limits specified herein for such pollutants and who are permitted to make such wastewater contributions to the system by decision of the Murray Sewer System Pretreatment Coordinator.
      (3)   Sewer service charges means charges levied on all users who discharge or cause or permit the discharge of sewage into the public water resource recovery system. Sewer service charges shall be comprised of a system of user charges, excessive strength surcharges and a system of charges for debt service.
      (4)   User charges means charges levied on the users of the Murray Sewer System to offset the cost of operations and maintenance of the system including normal replacement costs.
   (D)   User charges and debt service. The following schedule of rates shall apply to each user of the water resource recovery system. This schedule includes the rate for user charges as established herein and the rate for debt service charge, each based on the volume of metered water consumption unless otherwise noted.
      (1)   Wastewater rate schedule for inside city customers.

      The rates for each year subsequent to CY 2018 shall remain unchanged until such time as amended by ordinance.
   (E)   Water meters. In the event a lot, parcel of land, building or premises discharges sewage, water, or other liquid wastes, or uses water supplied on other than a metered basis from either a private or a public water supply, then the owner or occupant may be required to cause a water meter or other measuring device to be installed which is acceptable to Murray Municipal Utilities and the Department of Public Works and Utilities which are in charge and control of the municipal sewerage system. The quantity of water used, as measured by such meter, shall determine the sewage rate, rental or charge. Pending installation of such meter, the sewerage rate, rental, or charge shall be at the prevailing rates based on a consumption of six thousand (6,000) gallons per month. Said rate shall be determined by the rate schedules above and applied based on whether the real property is located inside the city limits or outside the city limits.
   (F)   Sewer tap-on fees. Each customer applying for a sanitary sewerage connection to the Murray Water System and water resource recovery system shall pay the fee set by the following sewer tap-on schedule:
      (1)   Sewer tap-ons, inside city, family residence - effective 07/01/2016:
         (a)   One thousand five hundred dollars ($1,500) for each single-family residence; and
         (b)   Six hundred dollars ($600) for each additional unit located within the same structure.
      (2)   Sewer tap-ons, outside city effective 07/01/2016:
         (a)   Two thousand one hundred dollars ($2,100) for each single-family residence; and
         (b)   Eight hundred forty dollars ($840) for each additional unit located within the same structure.
      (3)   In the event the cost to the city exceeds the above tap-on fees, a determination of the actual cost shall be made by the Director of Public Works and Utilities and such cost shall be the responsibility of the water or sewerage customer.
      (4)   The above tap-on fees are in addition to the water and sewerage rates presently in effect or which may hereafter be adopted.
   (G)   Sewerage rates and water consumption. Sewerage rates provided in subsection (D)(1) and (D)(2) above are based on the underlying assumption that all metered water consumption is eventually returned to the water resource recovery facility. Where it can be evidenced that the proportion of water actually returned to the treatment system by an industrial customer is significantly different from the metered consumption, service charges shall be determined on the basis of measured or estimated wastewater discharge. The city reserves the right to determine by whatever means and methods it may find practicable, the amount of water consumption or wastewater discharge that shall be used to compute sewerage service charges.
   (H)   Surcharge for excessive strength. Users having a discharge over the normal sewage strength of three hundred (300) mg/l suspended solids or two hundred fifty (250) mg/l BOD shall incur an additional charge of sixteen cents ($0.16) per pound of suspended solids, twenty-three cents ($0.23) per pound of biochemical oxygen demand (BOD), and thirty cents ($0.30) per pound for oil and grease over fifty (50) mg/l or limits as specified in the permit for categorical industries and thirty cents ($0.30) per pound for phosphorus.
   (I)   The foregoing rates and charges for the use of and services rendered by the Murray Water System and Murray Sewer System as established by subsections (D) through (H) of this section shall become effective from and after the date determined by City Council.
