§ 97.29 EMERGENCY CUTS.
   (A)   An emergency cut or excavation for purposes of this subchapter is a cut or excavation made necessary by reason of or resulting from some accident or unforeseen cause or event requiring immediate repairs or work to be performed upon facilities located in, under, or upon a public street, alley, parking lot, or public right-of-way in order to avoid a health hazard or damage or injury to life or property.
   (B)   Any person, firm, or corporation making any emergency cut or excavation shall give the Street Commissioner the most practicable notice of the emergency and their intent to make any proposed cut or excavation of any emergency nature and shall give, as soon as practicable, to the Clerk-Treasurer a written list of cuts or excavations made or to be made along with a sketch or drawing and permit fee for each cut or excavation.
   (C)   Except as to the ten-day notice requirement set forth in § 97.25, any person, firm, or corporation making any emergency cut or excavation shall comply with all other provisions of this subchapter.
