§ 97.25 APPLICATION FOR REQUIRED PERMIT; AUTHORITY.
   (A)   Any person, firm, or corporation desiring to cut or excavate the surface of any public street, alley, or parking lot in the city shall first obtain a permit from the city.
   (B)   In the case of an emergency, approval can be given by the Street Commissioner after the proper application has been completed and the fee is paid. The emergency application would be presented to the Board of Public Works and Safety at the next regularly scheduled meeting for acknowledgment. EMERGENCY is defined in § 97.29.
   (C)   Application for a permit shall be made not less than ten working days before the proposed cut or excavation is to be made. The application shall include a sketch or drawing showing the location, dimensions of the cut or excavation, and a statement of the estimated length of time required for completion of the work.
   (D)   The Board of Public Works and Safety of the city shall have the authority to:
      (1)   Issue street cutting permits on behalf of the city to persons, firms, or corporations requesting permission to cut or excavate public streets, alleys, parking lots, or public right-of-way.
      (2)   Establish forms for applications and permits and may establish any additional requirements it finds desirable for the protection of the city or its residents, provided that the application and requirements established by the Board may not reduce the requirements of this subchapter.
      (3)   Require the person, firm, or corporation making the application to meet and consult with the Board, or a representative of its departments or utilities, on all matters relating to the proposed cut or excavation.
