4-11-2: DEFINITIONS:
The following words are defined as follows for this chapter only:
DOORWAY:
The entryway primarily designated for customer access to a building.
DOWNTOWN PARKING OVERLAY (DPO):
See sections 9-12-2 and 9-12-3 of this Code.
MOBILE FOOD CONCESSIONS:
Peddling, vending, selling, displaying, or offering a consumable item for sale from a portable vehicle. Mobile food concessions can operate in various forms including, but not limited to, food trucks, food trailers, food vending carts and the like. Temporary buildings and children's vending stands are excluded from this definition.
PRIVATE PROPERTY VENDING:
Mobile food concessions where all aspects of the activity take place on property that is not public property.
PUBLIC PROPERTY:
Parks, parking lots, rights of way, and sidewalks owned or maintained by the State of Idaho, the City of Mountain Home, or any political subdivision thereof.
PUBLIC RIGHT OF WAY:
A strip of land dedicated or reserved for use as a public way, which normally includes streets, sidewalks and other public utilities or service areas. This definition does not include City parks.
SIDEWALK VENDING:
Mobile food concessions from a vending cart or vending area to persons on the public right of way, any sidewalk, or pedestrian access.
SPECIAL EVENT:
See chapter 4-12 of this Code.
STREET VENDING:
Mobile food concessions from a vending vehicle situated on the public right of way between the curb lines, or edges of pavement, to persons within the right of way or the public sidewalk.
VENDING AREA:
Any area used or anticipated to be used for mobile food concessions, including preparation, display, transactions, customer queuing, customer seating areas, and other associated activities.
VENDING CART:
A movable pushcart that is operated by a vendor standing on public property.
VENDING VEHICLE:
A vehicle operated by a vendor standing on or within the frame of the vehicle. (Ord. 1708, 12-28-2020)
