§ 99.27 VIOLATIONS.
   (A)   It shall be the concurrent duty of the Street Superintendent, Planning Director and Town Marshal to report all violations of this subchapter, and verify any complaints to be filed therefor.
   (B)   Any person who does any of the following shall be punished as provided in § 99.99, and shall be liable to the town in an action on the bond for any actual loss or damage sustained by the town by reason of any breach of the conditions of the bond or for any violation of this subchapter, to-wit:
      (1)   Makes an excavation or opening in or underneath the surface of any sidewalk, street, alley, or other public place in the town without a proper license from the town, or of larger dimensions than is authorized by the license;
      (2)   Fails, neglects, refuses, or omits to return his or her license promptly to the Clerk-Treasurer after filing an excavation;
      (3)   Fails to erect or maintain suitable warning signs, lights, or barriers at or near any excavation in order to prevent damage to persons and property;
      (4)   Fails to display his or her license for the excavation;
      (5)   Fails to fill in or resurface any excavation or opening promptly when the work has been completed, or correct any defects discovered within the two year discovery period;
      (6)   Fails to apply for or pay for a license;
      (7)   Fails, neglects, refuses, or omits to perform or discharge any other act or duty imposed by this subchapter.
