§ 96.17 MINIMUM STANDARDS.
   (A)   Single access private driveways. All single use private entrances, driveways or approaches shall be constructed in compliance with the provisions of the Morgan County Subdivision Control Ordinance, as amended, originally adopted on February 11, 2003.
   (B)   Multi-use, commercial and industrial driveways. All other entrances, driveways or approaches other than single access private driveways, including entrances to subdivisions, new roadways and commercial or industrial entranceways shall be constructed in compliance with the latest provisions of the Indiana Department of Transportation Driveway Permit Handbook ("INDOT Handbook"). The INDOT Handbook may require the construction of deceleration lanes, acceleration lanes, turn lanes, passing blisters and other such improvements. The permit applicant shall provide location studies, design plans or other such plans or engineering reports as necessary to comply with this subchapter.
   (C)   Right-of-way acquisition. The permit applicant shall provide proof of the acquisition of any right-of-way necessary for compliance with this subchapter. It shall be the obligation of the applicant to obtain and secure any right-of-way necessary. The applicant shall provide Morgan County any right-of-way necessary for the improvement of any portion of a county road, highway or street.
   (D)   Low volume multiple use driveway. Low volume multiple use private driveways shall be constructed and improved in accordance with division (A) of this section. A low volume multiple use driveway shall refer to any private driveway, entrance or approach that shall serve not more than five single family residences or two double family residences.
   (E)   Culvert pipe. Each driveway, when permanently completed, shall include a culvert pipe of sufficient length and width to properly convey surface water. The length and width shall be determined by the Department. Culvert pipe may consist of metal, concrete, or plastic, as determined by the County Highway Department and constructed as the Department directs.
   (F)   Temporary construction. As determined and directed by the Department, until construction is complete on the applicant's property, swales, ditches, and drainage basins, shall be temporarily filled with #2 stone. Prior to the issuance of a certificate of occupancy, the Department shall require the stone to be removed and the culvert pipe installed pursuant to the Department's specifications contained in the permit. The Department shall inspect the final installation of culvert pipe and the driveway prior to a certificate of occupancy being issued for the property.
