§ 96.01 GENERAL PROVISIONS.
   (A)   No mailboxes shall be installed, relocated, repaired or maintained along any street, road or right-of-way under the jurisdiction of the County Commissioners, except in accordance with the provisions of this section.
   (B)   No mailbox shall be installed, relocated, repaired or maintained in a manner such that the front of the mailbox be closer than two feet from a vertical line extended up from the edge of the pavement or, in the case of a gravel road, within two feet of the traveled portion thereof, and that the front face of the mailbox support structure be no closer than four feet from a vertical line extended up from the edge of the pavement or traveled portion of a gravel road.
   (C)   Mailbox support structures installed along county rights-of-way shall be constructed of four inches by four inches or smaller wooden posts, two inches diameter or smaller standard weight steel pipes, steel U-channel posts or metal fence posts of weights lighter than four pounds per foot of length, or other structures as may be specifically approved by the County Highway Department. Mailbox support structures made of masonry, stone, reinforced or unreinforced concrete, metal pipes larger than two inches diameter, concrete filled pipes, telephone pole selections or other specific types of structures deemed hazardous to motorists by the County Highway Department are prohibited.
   (D)   Any person or corporation who violates the terms of this section shall be subject to having the violating mailbox structure removed by the County Highway Department. The person or corporation in violation shall be held responsible for the costs of removal of said violation and for the subsequent cost of installing a non-violating mailbox structure.
   (E)   (1)   It shall be permissible to use a six-inch by six-inch wooden support post for a mailbox, so long as the mailbox is located within a platted subdivision along a road or street that has a designated speed limit of 30 mph or less.
      (2)   The maximum replacement value to be paid by the county for a mailbox located within two feet of a roadway and damaged or destroyed by the County Highway Department shall be the sum of $30. Otherwise, the maximum replacement value for a mailbox shall be $70. Notwithstanding the above, a mailbox which does not conform to the requirements of this section, or except mailboxes which otherwise conform to this section and are located within two feet of the roadway, shall not be subject to a claim for damages.
      (3)   In no event shall a reconstructed or replacement mailbox be permitted to be installed in violation of this section.
   (F)   (1)   In order to be eligible for a claim for damages under this provision, the mailbox must conform to the requirements of this section.
         (a)   Mailboxes which otherwise conform to the requirements of this section, but that are located within two feet of the roadway, shall be eligible for a claim for damages.
         (b)   The maximum replacement value to be paid by the county for a mailbox located within two feet of a roadway and damaged or destroyed by the County Highway Department shall be the sum of $30. Otherwise, the maximum replacement value for a mailbox damaged or destroyed by the County Highway Department shall be $70.
      (2)   In no event shall a reconstructed or replacement mailbox be permitted to be installed in violation of this section.
   (G)   No claim for damage to a mailbox by the county shall be approved for any mailbox damaged during snow removal, including mailboxes damaged by snow, ice or debris sprayed or discharged from a snow plow, unless the following conditions are met:
      (1)   The mailbox conforms to all requirements of this section; and
      (2)   The mailbox is struck by a vehicle or apparatus which leaves the travel portion of the roadway.
