§ 93.03 LICENSE; REQUIREMENTS.
   An applicant for a license in accordance with this chapter shall submit an application as described in § 93.04, which requires verification of all of the following:
   (A)   The applicant shall, in such application, advise of the maximum number of people that will be assembled or admitted to the location of the assembly. The maximum number may not exceed the maximum number that can reasonably assemble at the location of the assembly. If the assembly is to continue overnight, the maximum number is not more than is allowed to sleep within the boundaries of the location of the assembly by zoning or health ordinances of the unit;
   (B)   The applicant shall agree to furnish, at his or her expense, potable water meeting all federal and state requirements for purity in sufficient quantity to provide the maximum number of people to be assembled at the rate of at least one gallon per person per day and water for bathing at the rate of at least ten gallons per person per day;
   (C)   Separate and closed toilets for males and females meeting all state and local specifications, conveniently located throughout the area of the assembly and sufficient to provide facilities for the maximum number of people to be permitted at the rate of at least one toilet for every 150 females and at least one toilet for each 200 males together with sufficient sanitary means of disposing of waste matter deposited which is in compliance with all state and local laws and regulations. A lavatory with running water under pressure and a continuous supply of soap and paper towels shall be provided for each toilet;
   (D)   A sanitary method of disposing of solid waste in compliance with state and local laws and ordinances sufficient to dispose of the solid waste production for maximum number of people to be assembled at the rate of two and one-half pounds of solid waste material per person, per day, together with a plan for holding and collecting all such waste at least once a day at the assembly, and sufficient trash containers with tight-fitting lids and personnel to perform the task;
   (E)   If the assembly continues into the hours of darkness, sufficient illumination to light the entire area of the assembly at the rate of at least five foot-candles but not to shine unreasonably beyond the boundaries of the assembly;
   (F)   A free parking area inside the assembly grounds sufficient to provide parking for the maximum number of people to be assembled at the rate of one parking place for every four persons;
   (G)   If the assembly is to continue overnight, camping facilities in compliance with all state and local requirements sufficient to provide camping accommodations for the maximum of people to be assembled;
   (H)   Security guards or other regularly employed, duly sworn off-duty police officers, constables or private guards licensed in the state, sufficient to provide adequate security for the maximum number of people to be assembled at the rate of at least one security guard for every 750 people;
   (I)   Fire protection, including alarms, extinguishing devices, fire lanes and escapes sufficient to meet all state and local standards for the location of the assembly, and sufficient emergency personnel to operate efficiently the required equipment;
   (J)   Provide physicians and nurses licensed to practice in Indiana, at the rate of at least one physician for every 10,000 people and at least one nurse for every 5,000 people anticipated to be assembled, with one-half of the physicians and nurses to be on the site for which the license has been issued and the other one-half to be readily available;
   (K)   Provide an enclosed covered structure where treatment may be provided containing a separately enclosed treatment room for each physician;
   (L)   Provide at least one emergency ambulance available at all times;
   (M)   Provide telephones connected to outside lines sufficient to provide for the maximum number of people to be assembled, at the rate of at least one separate line and receiver for each 1,000 people;
   (N)   The applicant shall verify that reasonably necessary precautions will be taken to ensure that the sound of the assembly will not carry unreasonably beyond the enclosed boundaries of the location of the assembly; and
   (O)   The applicant shall file a bond with the Clerk of the Circuit Court, with said bond meeting the following conditions:
      (1)   Be either in cash or underwritten by a surety agent licensed to do business in Indiana;
      (2)   Be issued at the rate of $4 per person for the maximum number of people permitted to assemble;
      (3)   Indemnify and hold harmless the unit or the unit's agents, officers, or employees from any liability or causes of action that might arise by reason of granting the license and from any cost incurred in cleaning up any waste material produced or left by the assembly;
      (4)   Guarantee the state the payment of any taxes that accrue as a result of the gathering;
      (5)   Guarantee reimbursement to ticketholders if the event is canceled; and
      (6)   Guarantee to the county, or any other unit of government as applicable, repayment for actual expenses of repair or replacement of property owned by the unitor for which the unit is responsible.
