§ 93.04 LICENSE; APPLICATION PROCEDURE.
   (A)   The license for assemblies in accordance with this chapter shall be approved and issued by the Sheriff.
   (B)   Any person desiring a license in accordance with this chapter shall:
      (1)   Obtain an application from the Office of the Board of Commissioners and return the completed application at least 60 days prior to the date that the applicant intends to schedule such assembly;
      (2)   Submission of such application shall include a non-refundable processing fee of $200 payable to the Morgan County Commissioners;
      (3)   Such application shall contain and disclose the name, age, residence, and mailing address of all persons organizing and managing such assembly. In the event a corporation is making such application, a certified copy of the articles of incorporation together with the name, age, residence, and mailing address for each person holding at least 10% of the stock of the corporation;
      (4)   Such application shall further state the nature and purpose of the assembly, length for which the assembly is to be permitted, the maximum number of persons to be allowed at such assembly at any one time, rules and regulations concerning the conduct of such assembly, the maximum number of tickets to be sold, the maximum number of persons allowed to sleep within the boundaries of the location of the assembly by the zoning ordinances of the unit if the assembly is to continue overnight, and all plans necessary to assure the compliance with the provisions of this chapter;
      (5)   Such application shall further contain a legal description of the real estate together with the mailing address of said real estate, and the name, residence and mailing address of the person holding legal title to said real estate and any person holding equitable title to said real estate;
      (6)   Such application shall contain verification of compliance with the requirements for such license as identified in this chapter; and
      (7)   Such application shall contain a verification of acknowledgment of possible penalties for non-compliance as identified by this chapter.
   (C)   An application submitted shall be processed as follows:
      (1)   Upon timely receipt of an application for license under this chapter, the Secretary of the Board of Commissioners shall distribute a copy of the same to the County Board of Health, County Plan Commission, County Highway Superintendent, agency responsible for fire protection services in the location in which the event will be held, County Sheriff, and any other agency necessary to achieve the purpose of this chapter and I.C. 16-41-22.
      (2)   Each of the entities listed in (C)(1) of this section shall investigate as they deem necessary and appropriate, in consideration of the requirements for the issuance of said license in accordance with this chapter as those requirements pertain to the respective duties of each office in ensuring the health, safety, and welfare of attendees and the general public.
      (3)   After the investigation conducted in accordance with this chapter, each entity shall complete its report and return to the Office of the Board of Commissioners within 15 days of receipt.
      (4)   At such time as the entities listed in (C)(1) of this section have returned their reports to the Office of the Board of Commissioners, the Secretary of the Board of Commissioners will review said reports and the application and forward the same to the Sheriff.
      (5)   If the applicant has demonstrated compliance with this chapter, the Sheriff shall issue the person a license.
