§ 53.01 SEWER DEPARTMENT.
   (A)   There is hereby established an agency of the county known as the County Sewer Department (the “Department”), which shall be administered by a board known as the County Sewer Board (the “Board”). The Board shall consist of three members, such members to be the members of the Board of Commissioners, or a designated representative of any such member.
   (B)   The Department shall be operated through a contract with a vendor selected by the Board of Commissioners. User rates will be established for the works sufficient to pay debt service on any indebtedness undertaken by the county and to pay adequate consideration to the vendor for operation of the works.
   (C)   The Board shall have the same powers as a “board” as defined in I.C. 36-9-23-4 with respect to the management of the sewage works of the county including, without limitation, authority to establish rules and regulations regarding the use of such sewage works.
   (D)   This section shall be in full force and effect from and after its adoption by the Board of Commissioners and compliance with the procedures required by law.
