1315.01 DEFINITION.
   "Drive-in restaurant" for purposes of this chapter, means as follows:
   (a)    A restaurant which serves prepared food in a building and provides the facility where the customer may be served in a vehicle; or
   (b)    A building where food is served for consumption on the premises, either within a vehicle or at benches and tables provided for that purpose.

1315.02 MASONRY WALL REQUIRED; EXCEPTIONS.
   (a)    Where a drive-in restaurant is being operated within the City, and is located in an area adjacent to a residentially zoned area, the restaurant shall be separated from the residentially zoned district by a masonry wall, not less than six feet in height, along the boundary line separating the premises one from the other, for the entire length of the restaurant's property line.
   (b)    The wall shall not be required if the restaurant is separated from the residential district by a public street, alley, highway or thoroughfare.

1315.99 PENALTY.
   Whoever violates any provisions of this chapter shall be fined not more than one hundred dollars ($100.00). Each day's violation shall constitute a separate offense.
