745.02 PERMIT REQUIRED, ISSUANCE, REVOCATION AND POSTING.
   (a)    Owners or operators of restaurants or drive-in restaurants are hereby prohibited from remaining open for the conduct of business between the hours of 2:30 a.m. and 5:00 a.m. without having previously obtained a permit from the City Manager. The application shall be in such form as the Manager may prescribe and may be issued by the Manager in his discretion upon the showing by the applicant that the restaurant shall be operated in such a manner that any and all circumstances and conditions of nuisance actions and occasions for misdemeanors shall be avoided at all times.
   (b)    All permits issued hereunder are subject to immediate revocation at all times when at the discretion of the Manager there is evidence of circumstances or conditions of nuisance actions or occasion for occurrences of misdemeanors occurring at the subject restaurant to terminate operation of such restaurant between the hours of 2:30 a.m. and 5:00 a. m. Any three or more complaints received by the Manager shall be prima-facie evidence to revoke any permit.
   (c)    Such permit shall be prominently displayed in the restaurant at all times.
