(A) Any alarm user having false alarms at a specific site within a calendar year may be subject to an ordinance violation enforcement proceeding by the town and/or loss of permit, depending on the number of false alarms at that specific site emitted from an alarm system location within the calendar year, based upon the following schedule:
Number of False Alarms | Action Taken |
1-3 | Either a written notice of a false alarm or a warning letter |
4-5 | Filing of an ordinance violation enforcement proceeding or notice of a violation |
6-10 | Filing of an ordinance violation enforcement proceeding or notice of a violation and notice of possible revocation or suspension of permit |
Above 10 | Filing of an ordinance violation enforcement proceeding and notice of revocation or suspension of permit and a mandatory inspection as listed in § 93.05 of this code. |
(B) All suspensions shall be at the discretion of the Police Chief of the town, and reinstatement of permits shall likewise be at the discretion of the Police Chief, based upon evidence that the problems with the false reports have been cured. The failure to pay fines pursuant to this section shall also likewise constitute grounds for revocation of the permit granted pursuant to this chapter. In the event of a suspension the Police Chief shall give a written notice 15 days prior to the suspension, and during the time period, the alarm user shall be allowed to show what reasonable steps have been taken to eliminate or reduce the false alarms, and if sufficient steps have been taken, the Police Chief shall delay the suspension of the permit as long as no false alarms are reported within the next 30 days. This shall not relieve the alarm user from the payment of any fees for false alarms or other responsibilities under this chapter, and in the event of an additional false alarm within this time period, the Police Chief shall review the permit and make a determination of the status of the permit pursuant to this section and either terminate the permit or grant the alarm user an additional 15 days to discover and eliminate the cause or causes of the false alarms.
(C) Any alarm user having failed to obtain a permit as required under § 93.04 of this code or who has failed to display the insignia with the permit number on it as required under § 93.04 of this code shall be subject to an ordinance violation enforcement proceeding. This chapter shall be enforced by the Police Chief of the town, any police officer of the town or duly appointed representatives including the town’s Fire Department representative who shall have the authority to file an ordinance violation enforcement proceeding in the Town Court.
