§ 93.99 PENALTY.
   (A)   Any person, firm or corporation who violates, disobeys, omits, neglects, refuses to comply with or resists enforcement of any of the provisions of this chapter shall upon conviction be fined not less than $25 and no more than the amount permitted under I.C. 36-1-3-8(a)(10)(B) for each such violation, act or omission or offense. Each day that a violation is permitted to exist shall constitute a separate offense.
   (B)   Any person violating any section of this chapter in lieu of being charged for said violation in Town Court or a court of competent jurisdiction may pay, within five days after receiving notice of a violation, to the Clerk-Treasurer the sum of $25 provided, however, if said amount is not paid within five days after being advised of the violation of his or her right to pay in lieu of being charged, said personal shall be charged with the violation in accordance with the law in Town Court or a court of competent jurisdiction.
   (C)   Any person charged with a violation of this chapter may be granted a two-week continuance to pay the amount to the Clerk-Treasurer before being charged with a violation in Town Court or a court of competent jurisdiction, provided the continuance is granted in writing either by the Clerk-Treasurer or by the Police Chief of the town. Any person paying to the Clerk-Treasurer the fine as called for herein within the time allowed or any extension allowed, shall not be subject to the per day violation provision of this chapter. It shall be the duty of the Police Department to furnish a copy of the ordinance enforcement document to the Clerk-Treasurer within 72 hours after the issuance of the ordinance enforcement document.
   (D)   All fees, fines and other monies collected by the town under the provisions of this chapter shall be deposited into the Alarm Fund of the town as revenues and shall be deemed a reimbursement to the town for its expenses in the issuance of licenses and the enforcement of the provisions of this chapter.
