RIDER "A"
POWER SUPPLY COST ADJUSTMENT APPLICABLE TO ALL
VILLAGE'S RATE SCHEDULES
POWER SUPPLY COST ADJUSTMENT: The rates and charges set forth in Village's Rate Schedules are based upon the cost of Village's power supply as furnished by American Municipal Power of Ohio per Montpelier/AMP-Ohio Agreement dated July 15, 1987.
In the event that the Village's average power supply costs per kWh is INCREASED or DECREASED due to changes in said resale base rate, fuel cost, tax, or other adjustments or modifications to the Village's power supply arrangements, Village's Rate Schedules to which Rider "A" applies will be adjusted as specified below:
(1) BASE POWER SUPPLY COST:
The overall Base Power Supply Cost to be used to determine the adjustment applicable to Village's Rate Schedules shall be that included in the Village's retail rates of $0.077273 per kWh.
(2) MONTHLY DETERMINATION OF POWER SUPPLY COST ADJUSTMENT:
(a) Each month, the Village's running three-month average Power Supply Cost per kWh shall be determined by dividing (1) the sum of the previous two and current months' total power supply costs from all suppliers, plus the sum of the previous two and current months' costs associated with ownership and operation of generating facilities owned in whole, or in part, by the Village, plus the sum of the previous two and current months' transmission related charges and AMP-Ohio Service Fees, by (2) the total energy delivered to the Village in the previous two months and current month.
(b) If said running three-month average Power Supply Cost for the current month is ABOVE or BELOW $0.077273 per kWh (determined to 6 decimal places or $0.000000), the rates per kWh set forth in Village's Rate Schedules shall be INCREASED or DECREASED in the manner specified in (c) & (d) below.
(c) Any INCREASE or DECREASE per kWh ABOVE or BELOW the base cost of $.077273 per kWh shall be determined to 6 decimal places and any resultant differential shall be multiplied by 1.10 to compensate for Village's Distribution System Energy Losses.
(d) The rates per kWh set forth in Village's Rate Schedules shall be INCREASED or DECREASED accordingly.
(3) APPLICATION OF POWER SUPPLY COST ADJUSTMENT TO ALL CUSTOMER BILLS:
(a) Any applicable adjustment shall be applied to the kWh billed Consumer for the meter reading period that Village determines as most nearly corresponding to the meter reading period(s) set forth in Village's purchased power billings from its supplier(s).
(b) All adjustments shall be applied to the total kWh billed to Consumer and shall be in addition to the minimum charge applicable for the schedule involved.
(c) Security Lighting Schedule "SL" adjustment shall be as specified in said schedule.
SCHEDULE "GS"
GENERAL SERVICE FOR NON-RESIDENTIAL SERVICE
AVAILABILITY: This Schedule is available and applicable throughout Village's (hereinafter referred to as Utility) entire service area for all Single and/or 3-Phase Non-Residential Service not specified in or for which Utility's Residential Service Schedule "R" is not applicable. It also applies to Residential Service where the installed or allocated nameplate rated transformer capacity exceeds 25 kVa.
This Schedule applies to all 3-Phase Service, whether Residential or Non-Residential.
Schedule "GS" is applicable to all service furnished to retail or wholesale businesses, manufacturing or processing establishments, hotels, motels, mobile homes, trailer camps, stores, restaurants, service stations, professional offices, theaters, amusements, offices, schools, churches, clubs, lodges, multiple dwelling units, apartment houses, public buildings, etc. and all other service that is not strictly individual Residential or Home Use in character.
For new loads, Utility reserves the right to limit the availability of this schedule to a maximum load of 150 kVa. See Section 1 of "Other Terms & Conditions" that follows.
All Service under Schedule "GS" is subject to the provisions of this Schedule and Utility's General Rules and Regulations or subsequent revisions thereof, as if fully
written herein.

Capacity
All Billings are subject to the provisions relating to: Determination of Billing Capacity, Monthly Minimum Charge, Purchased Power Cost Adjustment and other provisions hereinafter set forth.
For Billing where combined single and 3-Phase service is furnished, see Sections 3, 4 & 5 under "Other Terms and Conditions".
DETERMINATION OF BILLING CAPACITY: The Billing Capacity shall be the highest measured 15 minute integrated or equivalent thermal kW Capacity determined to the nearest kW by means of suitable metering equipment. However, the Billing Capacity shall be not less than the Minimum Billing Capacity specified in Consumer's Contract with Utility.
Utility reserves the right at any time to install Capacity Metering Equipment. Utility will normally install Capacity Metering Equipment when Consumer's usage in any month exceeds 10,000 kWh.
Where Capacity Metering Equipment is installed and the power factor at time of Maximum measured Capacity is less than 90%, Utility reserves the right to determine the Billing Capacity based on the measured kVa Capacity instead of kW Capacity. Where Capacity Metering Equipment is not installed, the Billing Capacity may be estimated by Utility based on periodic tests or other reasonable basis as determined by Utility.
For highly fluctuating loads, such as welders, hoists, and the like, the measured kW Capacity shall be increased by an amount that is equal to 80% of any separately installed or allocated kVa of transformer capacity required to supply such fluctuating loads.
MONTHLY MINIMUM CHARGE PER SERVICE: The Monthly Minimum Charge shall be not less than the highest Minimum Charge as determined by any of the following methods:
(a) For Single Phase Service Only: The Monthly Minimum Charge shall be the applicable Service Charge.
(b) For 3-Phase, 3 or 4 wire service the Monthly Minimum Charge shall be $30.00 but not less than the Minimum Charge that may be specified by Contract with Utility. For 3-Phase service, the applicable Monthly Minimum Charge shall apply on a year around continuous 12 consecutive months basis or longer as may be specified by Contract. Therefore, any Seasonal Disconnection of 3-Phase service shall not avoid the Applicable Minimum Charge, except under (d) below.
(c) Where 3-Phase service is furnished thru a single 3 or 4 wire service drop, in order to ascertain compliance with respect to the single and 3-Phase Minimum Charges specified in (a) & (b) above, Utility reserves the right to separately meter the single and 3-Phase service and add the meter readings together and calculate the bill as though served thru a single meter. However, the resultant combined total billing SHALL IN NO EVENT BE LESS than the aggregate amount of what the billing would otherwise be, based on the separate billing of the single phase metered service and its Applicable Minimum Charge specified under (a) above, PLUS the Applicable Minimum Charge for the separately metered 3-phase service specified under (b) above.
(d) For service furnished to activities such as charitable, philanthropic, non-profit community activities, (athletic fields, swimming pools, parks, and the like), the Monthly Minimum Charge shall be the applicable Monthly Minimum Charge as determine in (a) or (b) above. The applicable Monthly Minimum Charge shall apply to a Minimum Billing Period of not less than 4 consecutive months each time service is connected.
For Temporary Service furnished to fairs, carnivals and the like, Consumer shall pay for all of the "Up and Down" installation costs as specified in Utility's General Rules and Regulations and the minimum Billing Period shall be not less than 1 month.
(e) For installations that are unusual character as to electric usage requirements and/or investment, the Monthly Minimum Charge and Minimum Billing Capacity will be determined by Utility and shall be set forth in the Service Application or Contract with Consumer.
POWER SUPPLY COST ADJUSTMENT: The Rates and Charges set forth in this Schedule are subject to Increase or Decrease in conformance to the adjustment specified in Utility's Rider "A".
EXCISE (KWH) TAX ADJUSTMENT: For all customers located outside the Village's corporation limits, the rates and charges set forth in this schedule shall be increased by an amount equal to the excise (kilowatt-hour) tax imposed o the Village's electric distribution system under Ohio Revised Code 5727.81. Said increase shall be automatically adjusted to reflect any change in the kilowatt-hour tax imposed by Ohio Revised Code 5727.81.
TERMS OF PAYMENT: The above rates and other applicable charges are Net as shown and already reflect the Discount given from the Gross Rates if all accounts due and payable are paid on or before the final payment date specified on bill. If all accounts are not so paid, the Gross Rates are Due and Payable which are 10% but not less than $2.00 higher than the foregoing Net Rates. If any bill is not paid within 30 days after the payment date specified on bill, service shall be subject to Disconnection as provided in Utility's Rules and Regulations. To partially compensate Utility for the additional expense involved, any Disconnection or Reconnection of Service shall be subject to Utility's applicable Trip Charge.
OTHER TERMS & CONDITIONS
1. Limitation of Schedule "GS": When, in opinion of Utility the system capacity required to adequately supply Consumer's existing and probable future requirements, exceeds 150 kVa, Utility reserves the right to require Consumer to make the necessary complete substation installation. In such an event all service will be billed under Utility's Schedule "LP" and Consumer shall receive the specified Substation Discount.
2. Character of Service: For new installations, service will normally be supplied through a single set of service wires with all service delivered to a single meter location. Under such conditions a single bill will be rendered for service.
The service voltage shall be specified by Utility. At Utility's option it may be either 120/240 volt Single Phase, 3 wire; 240 or 480 volt, 3-Phase, 3 wire; or 120/208 or 277/480 volt 3-Phase, 4 wire. If Consumer desires a voltage that is impractical for Utility to furnish, Consumer shall furnish at his expense the necessary transformers to deliver such Voltage.
3. Availability of 3-Phase Service: Normally only single-phase service is available. Utility may, at its option, furnish 3-phase service if such service is already available immediately adjacent to Consumer's premises and if it is practical and economical for Utility to furnish 3-phase service, after giving consideration to the investment required and probable use of 3-phase service by Consumer; also providing Consumer enters into an appropriate Contract covering the investment involved.
The Minimum Charge and financing of any 3-phase line extension shall conform to Utility's General Rules and Regulations.
4. Single Billing If Service Is Supplied Thru Single Service Drop: Where service is supplied through a single service drop either 3 or 4 wires extending to a single service entrance and meter location designated by Utility, a single bill will be rendered, whether or not Utility elects to use single or multiple metering.
5. Multiple Billing Where Service is Supplied Thru Multiple Service Drops: Where service is delivered at different meter locations thru individual and separately metered single and 3-phase service drops a separate bill will be rendered for each service drop location.
6. Requirements To Qualify for Single Billing: If Consumer arranges his wiring at his cost so that all requirements can be supplied by means of a single 3 or 4 wire service drop extending to a single meter location designated by Utility and providing that such service can be supplied from a single transformer bank and metered thru a single meter, a single bill will be rendered for such service.
In place of a single meter, Utility reserves the right to use separate single and 3-phase meters in order to determine Minimum Charge compliance as specified in (c) under "Monthly Minimum Charge Per Service".
7. Metering Voltage: Under the Schedule "GS", Utility reserves the right to meter Consumer's requirements in the most practical manner either at Utility's secondary or primary distribution voltage and in either case of the billing kWh shall be the metered kWh.
8. General Service Classification For Billing Purposes: In determining Consumer's Classification for billing purposes, any establishment carrying a business, professional, commercial or non-residential telephone directory listing shall automatically be classified as being Non-Residential in character and Schedule "GS" shall apply. However, the absence of such listing shall not be the determining factor in establishing whether or not the service utilization is Non-Residential in character.
9. Combined Residential & Non-Residential Service: Where the premises are used and occupied by a Consumer for both Residential and Non-Residential use as defined herein, all service shall be billed under Schedule "GS" or at Consumer's option the wiring may be separated (subject to Utility's inspection & approval). In such an event each class of service will be separately metered and billed under the applicable Schedule.
10. Definition of General Service: Service furnished outside of Utility's Corporate Limits shall be considered General Service in Character where such service is not incidental to Residential Use. Such service includes that used to prepare or process food or other products to the extent that same are substantially in a form that they can be used or can be readily adopted for use by, or for sale to the ultimate Consumer.
In addition, all electric service supplied outside Utility's Corporate Limits for activities, purposes, or uses, that when carried on within Utility's Corporate Limits would be classified as being Non-Residential in character and so billed, shall likewise be considered and defined as Non-Residential in character and Schedule "GS" shall apply. For the billing of Combined service, see preceding Section 9.
11. 3-Phase Service is Required for Unbalanced or Fluctuating Loads: For highly fluctuating loads such as welders and electric melting furnaces and/or unbalanced single phase loads, Utility reserves the right to require Consumer to operate such loads at 3-phase, with the loads balanced as far as practical, substantially equal on each phase. As an alternate, Utility reserves the right to require Consumer to supply such fluctuating loads by means of 3-phase motor driven generator set.
12. Motor Specifications: Single Phase Service will not be furnished to operate individual motors in excess of 15 HP rating, except where written permission is granted by Utility.
All motors 10 HP and larger may, at Utility's option be required to be equipped with reduced voltage starting equipment or other devices, to avoid unnecessary voltage surges and fluctuations on Utility's system.
Motors designed for full voltage "across the line" starting may, at Utility's option be permitted to operate on Utility's system, provided however that Utility has determined that such operation will not be detrimental to service furnished others.
13. New Line Extensions: All New Line Extensions or the furnishing of additional capacity shall be subject to Utility's General Rules and Regulations covering same.
14. Temporary Service: For Temporary Service the Consumer shall pay all charges specified in Utility's General Rules and Regulations, which include all "Up and Down Costs" and the Consumer shall make a suitable Deposit to cover all the costs involved.
15. Other Charges For Special Service: See Utility's General Rules and Regulations as to charges for Disconnection and Reconnection of Service and for other Special Services.
16. Use of Service: Service under this Schedule shall not be resold or shared with others.
SCHEDULE "M"
MUNICIPAL SERVICE RATE
AVAILABILITY AND APPLICABILITY: This Schedule is only available for, and applicable to facilities owned and operated by the Village's Water and Wastewater Departments. All Service under this Schedule "M" is subject to the provisions of this Schedule and Utility's General Rules and Regulations or subsequent revision thereof, as if fully written herein.
NET RATES PER MONTH OR PART THEREOF PER SERVICE:
The Billing for all Residential Service shall be the sum of the charges set forth below:
Service Charge: N/C
Energy Charge: All kWh @ $0.085 per kWh
The above charges are subject to the Minimum Charges, Power Supply Cost Adjustment and other adjustments that follow.
All Billings are subject to the provisions relating to Power Supply Adjustment hereinafter set forth.
POWER SUPPLY ADJUSTMENT: The Rates and Charges set forth in this Schedule are subject to the adjustments specified in Utility's Rider "A".
SCHEDULE "P"
LARGE POWER SERVICE
AVAILABILITY: This Schedule is available to all Consumers located along existing electric distribution lines of Village (hereinafter referred to as Utility) who use Utility's Standard Service and who guarantee the Monthly Billing Capacity specified by Service Application or Contract, but not less than 50 kW.
Where substation capacity in excess of 150 kVa is required to supply Consumer's existing and probably future requirements, Utility reserves the right to require Consumer to install the necessary complete substation equipment and this Schedule "P" shall apply. See elsewhere as to character of service, voltages, metering, discount applicable where Consumer furnishes complete transformation equipment, etc.
Service under this Schedule will be furnished only on a 12 months non-seasonal basis by Contract in accordance with the following stipulations and also in accordance with Utility's General Rules and Regulations or subsequent revisions thereof, which are a part of this Rate Schedule as if fully written herein.
A separate bill shall be rendered for each separate service drop and meter location.
NET RATE PER MONTH PER SERVICE OR PER TRANSFORMER INSTALLATION:
The total Monthly Billing shall be the sum of the charges, (A), (B), (C) & (D) that follow:
(A) Service Charge: $ 50.00 Per Month
(B) Capacity Charge: $ 8.50 Per kW of Billing Capacity
(C) Reactive Charge: $ 1.00 per RkW
(D) Energy Charge: $ 0.081 Per kWh
All Billings under the above Rates shall be subject to the provisions hereinafter set forth relating to: (a) Determination of monthly kW Billing Capacity; (b) Power Supply Cost Adjustment; (c) Discount For Furnishing of Substation by Consumer; (d) Billing Where Utility furnishes Multiple Transformer Banks; and (e) Monthly Minimum Charge, etc.
MONTHLY MINIMUM CHARGE: The Monthly Minimum Charge under this Schedule shall be $8.50 per kW of Billing Capacity as hereinafter determined plus the Service Charge of $50.00 per month, but not less than the Minimum Charge specified in Consumer's Service Application or Contract with Utility.
Said Minimum Charge shall not be reduced by reason of the Application of the "Discount for Furnishing of Substation", as hereinafter provided for.
There shall be added to the Minimum Charge as determined above, any applicable Power Supply Cost Adjustment. Said Adjustment shall be applied to the Billing kWh as hereinafter determined.
The Minimum Charge is applicable on a 12 months year around basis and Seasonal Disconnects will not avoid the applicable Minimum Billing Capacity and resultant Minimum Charge except as provided under (d) of "Determination of monthly kW Billing Capacity".
DETERMINATION OF MONTHLY KW AND RKW BILLING CAPACITY: The kW and RkW Billing Capacity (to nearest kW) shall normally be determined by measurement, using the highest 15-minute integrated or equivalent thermal kW and RkW capacity.
Where highly fluctuating or intermittent loads, welding machines, electric furnaces, hoists, elevators, X-Rays and the like are operated by the Consumer, Utility reserves the right to determine the kW Billing Capacity by averaging Consumer's total load over a 2 minute period or by increasing the 15 minute Measured Maximum kW Capacity in operation by the Consumer by 50% of the kVa name plate rating of said fluctuating load equipment.
Where such fluctuating loads require additional or separate transformers or additional system capacity, the Measured kW Billing Capacity as determined above shall be increased by 70% of the name plate rated kVa capacity of the separate transformer that serves such fluctuating load.
The kW Billing Capacity shall be determined as above, but in no event shall it be less than 50 kW nor less than the highest kW as determined by any of the following methods:
(a) The Minimum kW Capacity specified by Utility and set forth in Consumer's Service Application or Contract with Utility. In specifying paid Minimum Contract Capacity in kW, Utility will take into consideration the system capacity and companion investment required and/or reserved in order to adequately supply both the Consumer's initial and probable future requirements.
(b) 50% of Highest Measured kW during the immediate preceding 11 months period.
(c) For Consumers with a time-differentiated demand meter installed, the measured demand will be the greater of the maximum measured demand in the on-peak period or 50% of the maximum measured demand during the off-peak period. The peak period is defined as the twelve-hour period between 7 a.m. and 11 p.m. on all non-holiday weekdays. All other time is defined as off-peak. Holidays are New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day.
This off-peak provision is available to any Schedule "P" Consumer that pays the Utility for the complete installed cost of the metering equipment necessary for determining time-differentiated demands.
BILLING KW, RKW AND KWH: The foregoing rates are based upon all service being metered at Utility's Primary Voltage available at Consumer's premises. Utility reserves the right to meter at either the Primary or Secondary Voltage as determined by Utility. If metered at Secondary Voltage, the Billing kW, RkW and KWh shall be the metered kW, RkW and kWh multiplied by 1.03.
For further definition of Primary and Secondary Service and Voltage, see "Discount for Furnishing of Substation Equipment by Consumer".
POWER SUPPLY COST ADJUSTMENT: The Rates and Charges set forth in this Schedule are subject to Increase or Decrease in conformance to the adjustment specified in Utility's Rider "A".
EXCISE (KWH) TAX ADJUSTMENT: For all customers located outside the Village's corporation limits, the rates and charges set forth in this schedule shall be increased by an amount equal to the excise (kilowatt-hour) tax imposed o the Village's electric distribution system under Ohio Revised Code 5727.81. Said increase shall be automatically adjusted to reflect any change in the kilowatt-hour tax imposed by Ohio Revised Code 5727.81.
BILLING WHERE MULTIPLE TRANSFORMER BANKS ARE FURNISHED: Service under this Schedule is based upon Utility furnishing all service at a single voltage thru 1 transformer bank. Utility may, at its option, supply additional voltages thru additional transformer banks.
Where Utility furnishes more than 1 transformer bank, Consumer shall pay a transformer rental charge of .25 per kVa of the name plate rating of the additional transformer banks furnished by Utility in excess of 1 transformer bank.
Utility reserves the right to meter multiple transformer banks at secondary voltage and to bill each transformer bank separately or to meter and bill all service at primary voltage thru a single meter.
DISCOUNT FOR SUBSTATION OWNERSHIP BY CONSUMER
1. In order to adequately supply Consumer's initial and contemplated future electric power requirements Utility may specify the Nominal Primary Delivery Voltage, which shall be either 4,160, 12,500, 34,500 or 69,000 volts.
2. In the event that the Utility determines the service to be furnished to Consumer is Primary Service supplied at Primary Voltage and Consumer furnishes the complete substation equipment, the Discount to be applied to the Applicable kW Billing Capacity shall be as follows: $0.35 per kW for 4,160 volts service and higher.
The size, capacity and other Substation Specifications shall be determined by Utility and the entire installation shall conform to Utility's Specifications and Standards.
The resultant Discounted Bill for Substation Ownership shall not be less than the Applicable Monthly Minimum Charge as determined herein or by Contract.
SCHEDULE "R"
RESIDENTIAL SINGLE PHASE SERVICE
AVAILABILITY & APPLICABILITY: This Schedule is available and applicable throughout Village's (hereinafter referred to as Utility) entire service area for only single phase service supplied where no more than 25 kVa of installed or allocated name plate rated transformer capacity is required to serve what is ordinarily designated and recognized as individual Single Family Homes, Apartments, Mobile Homes, and other individual Single Family Dwelling Quarters, including incidental farm use.
All service under this Schedule shall be single phase delivered through a single set of service wires, the service location to be designated by Utility. Where service is supplied through one meter to more than a single family dwelling unit or living quarters or apartment see "Multiple Dwelling Units" as to billing procedure.
This Schedule is not applicable for service utilization that is ordinarily considered by public utility operation as being Non-Residential, Non-Home, or Non-Farm use in character.
Where the installed or allocated name plate rating of the transformer capacity exceeds 25 Kva per Consumer or where 3 phase service is furnished, Utility's General Service Schedule 'GS' shall apply.
Where electric service supplied for combined Residential and Non-Residential use, the General Service Schedule 'GS' shall apply or for all such single metered service. However, at Consumer's option and at his expense, the wiring may be separated (subject to Utility's inspection and approval) and each class of service separately metered and billed in conformance to the applicable schedule.
All applications for service shall be in accordance with the provisions of Utility's Standard Application Form and in accordance with the provisions set forth in this Schedule and also in accordance with the Utility's General Rules and Regulations or subsequent revisions thereof on file at the Utility Office, which General Rules are a part of this Schedule as if fully written herein.
NET RATES PER MONTH OR PART THEREOF PER SERVICE:
The Billing for all Residential Service shall be the sum of the charges set forth below:

First 500 kWh @ $ 0.116 per kWh
Next 500 kWh @ 0.111 per kWh

The above charges are subject to the Minimum Charges, Power Supply Cost Adjustment and other adjustments that follow.
MONTHLY MINIMUM CHARGE: The Monthly Minimum Charge per Consumer, shall be the sum of the foregoing charges but not less than Service Charge.
ADJUSTMENTS TO APPLY TO RATES AND MINIMUM CHARGES: The foregoing Rates and Minimum Charges shall be subject to Increase or Decrease to the extent that the following provisions and adjustments hereinafter set forth are applicable:
(a) POWER SUPPLY COST ADJUSTMENT: The Rates and Charges set forth in the Schedule are subject to the Adjustments set forth in Utility's Rider "A" and same shall apply.
(b) EXCISE (KWH) TAX ADJUSTMENT: For all customers located outside the Village's corporation limits, the rates and charges set forth in this schedule shall be increased by an amount equal to the excise (kilowatt-hour) tax imposed o the Village's electric distribution system under Ohio Revised Code 5727.81. Said increase shall be automatically adjusted to reflect any change in the kilowatt-hour tax imposed by Ohio Revised Code 5727.81.
(c) MULTIPLE DWELLING UNITS: The Schedule is applicable where not more than 1 dwelling unit, apartment, living quarters, mobile home or activity is supplied through 1 meter. Where 6 or more living quarters or dwelling units are served through 1 meter as of the effective date of this Schedule and for future dwelling units that are not separately metered, Utility's General Service Schedule "GS" shall apply.
(d) SEASONAL SERVICE: Seasonal Service shall be defined as service that is furnished for normally less than 12 months to homes, cottages, mobile homes, farm labor camps, cabins, wells, etc. Such seasonal service will be furnished only where Consumer's premises are located immediately adjacent to Utility's distribution facilities. Any line extension required will be subject to Utility's regulations and requirements pertaining to same.
Such Seasonal Service shall continue for not less than 6 consecutive months each time service is established. Utility's Trip Charge shall apply each time that service is Connected or Disconnected. All such Service Applications shall be in the name of the Property Owner, who shall pay all bills.
TERMS OF PAYMENT: The above rates and other applicable charges are Net as shown and already reflect the Discount given from the Gross Rates if all accounts due and payable are paid on or before the final payment date specified on bill. If all accounts are not so paid, the Gross Rates shall be Due and Payable which are 10% but not less than $1.00 higher than the foregoing Net Rates.
If any bill is not paid within 30 days after the payment date specified on bill, service shall be subject to Disconnection as provided in Utility's Rules and Regulations. To partially compensate Utility for the additional expense involved any Disconnection or Reconnection of Service shall be subject to Utility's Applicable Trip Charge.
BUDGETED TERMS OF PAYMENT: Upon the request of the Consumer who utilizes electric service for heating his home, a Budget Plan for the payment of electric service bills may be elected by Consumer. Based on actual experience (or estimated where actual experience is not available), the Utility will compute the annual electric service bill for all purposes and divide same by 12. The result shall be the amount to be paid by Consumer as his "Average Monthly Budget Bill".
The Annual Billing Period ends with the July Regular Meter Reading Date of each year and the difference between the billing for the kWh actually used by Consumer and the amount actually paid under the Budget Plan shall be properly reflected in the following August bill, which will be in addition to the regular budgeted billing. Any overpayment will be credited to Consumer's future billing.
OTHER TERMS AND CONDITIONS:
1. Application For Service & Responsibility for Payment of Bills: Where the premises are occupied by a Tenant, Utility reserves the right to require that the Application for Service be in Property Owner's name, who shall be responsible for the payment of all bills. In such an event the bill may be mailed direct to the Tenant, with a copy to the Property Owner. In addition, the Tenant may be required to make a suitable Deposit to secure bill payment. However, such Deposit is for protection of the Property Owner and in no manner will such Deposit relieve Property Owner of his responsibility for payment of all bills for the property involved.
2. Application for Temporary Service: For Temporary Service, Utility's General Rules and Regulations shall apply. Utility reserves the right to require that Applications for Temporary Service be in the name of the Property Owner, who shall pay all electric service bills. Each time that service is established, same shall be subject to the Utility's applicable "Turn-On" and "Turn-Off" trip charge for such Temporary Service.
3. Character of Service Furnished: The type of service furnished under this Schedule shall be single phase at a nominal potential of approximately 120/240 volts, 3 wire. At sole option of Utility, 120 volts, 2 wire service may be furnished.
This Schedule is not applicable for 3-phase service. If 3-phase service is supplied Utility's General Service Schedule "GS" shall apply to all service -- both single and 3-Phase.
4. Motor Size Limitations. The size of individual single-phase motors shall not exceed 15 HP nameplate rating except where written permission is granted by the Utility. Utility reserves the right to require that all motors 10 HP and larger be equipped with reduced voltage starting equipment so as to avoid unnecessary voltage surges on Utility's system.
5. Use of Service: Service under this Schedule shall not be resold or shared with others, except as heretofore provided under "Multiple Dwelling Units".
6. Other Charges For Special Services: See Utility's General Rules and Regulations as to charges not set forth herein, applicable for the Disconnection and Reconnection of Service and the Charges to be made for other Special Services furnished Consumers.
SCHEDULE "SL"
OUTDOOR SECURITY LIGHTING
AVAILABILITY: Available to Consumers where Village's (hereinafter called Utility) standard outdoor lighting unit can be installed on Utility's existing Pole and without requiring any extension or addition to Utility's existing secondary or primary distribution facilities.
Where additional facilities are required, the Consumer shall pay in advance the total installation cost for the additional distribution facilities (poles, wires and appurtenances) as are required. In all cases the lighting fixture itself, including lamp will be installed, owned, operated and maintained by Utility.
The service is available only where there is assurance that the service to be furnished will be permanent, Utility reserves the right to refuse to furnish such service when, in Utility's opinion, the installation will not be of permanent character.
APPLICATIONS FOR SERVICE: All Applications shall be on a 12 months per year around service basis. Where the premises are occupied by a Tenant, Utility reserves the right to require the Application for Service to be made by the Property Owner with bills to be sent to the premises to the attention of the Tenant. However, the Property Owner shall be responsible for the payment of all bills.
CHARACTER OF SERVICE: The Utility will install, own, operate and maintain at its expense the necessary mast arm mounted lighting unit and related appurtenances.
The lighting unit shall be a metal halide or high-pressure sodium type of luminary. The lighting unit shall be photoelectric or otherwise controlled so as to provide substantially dusk to dawn year round lighting service of approximately 4,000 hours operation per year.
NET RATE: The Net Rate Per Overhead Mercury Vapor or equivalent lighting unit shall be:

MINIMUM CHARGE: This lighting service is furnished only on a permanent, continuous 12 months year around basis. The Annual Minimum Charge Per Lamp is payable Monthly and disconnection of service will not avoid the applicable Annual Charge Per Lamp.
ADVANCE PAYMENT OF ANNUAL CHARGE: When determined by Utility that Consumer's regular service is seasonal or non-permanent in character. Utility reserves the right to require 12 months advance payment before service is established and thereafter to require similar advance payments prior to the commencement of each succeeding 12 months of service.
PAYMENT AND BILLINGS: The Monthly Charge Per Lamp will be set forth as a separate item on Consumer's bill and shall be payable in the same manner and shall be subject to the Gross and Net Billing for Consumer's companion metered electric service.
If not paid, as specified, all electric service, including the regular metered service, shall be subject to Disconnection as provided by Utility's General Rules and Regulations.
