(a) Any person owning or having charge of land within the Village within 200 feet of any residential or commercial building shall keep said land free of high grasses and weeds. “High grasses and weeds” shall be any grasses or weeds in excess of ten inches high. A parcel of land shall not be deemed free of high grasses and weeds unless the cuttings have been removed from the land or mulched so as to no longer be visible from the abutting lands. Land with high grasses and weeds is hereby declared to be a public nuisance.
(b) Upon information that high weeds and grasses are growing on lands in the Village, the Village Manager shall cause written notice to be served on the owner or person having charge of such lands, which notice shall advise that such grasses or weeds must be cut within five days after service of such notice. If the owner or person having charge of the land is a resident, the notice may be served by any person authorized by the Village Manager by personally serving such owner or person having charge of the lands, or by leaving a copy with a responsible person at the residence, or by posting a copy in a conspicuous place at the residence. If the owner or person having charge of such land is a nonresident of the Village, and his address is known, such notice may be served in the same manner as a resident or may be served by certified or regular mail. If such person’s address is unknown, it shall be sufficient to publish such notice once in a newspaper of general circulation in the county or post such notice in a conspicuous place on the land. The Village Manager shall determine the particular type of service to be used.

(c) The Village Manager or the Village Manager's designated agent is only required to serve one notice per calendar year under Section 1305.06(b). If, after a notice has been served in accordance with Section 1305.06(b), the Village Manager or the Village Manager's designated agent determines that a subsequent violation has occurred within the same calendar year, the Village may proceed with the remedies under Section 1305.99 without further notice.
