1305.99 PENALTIES; REMEDY BY VILLAGE.
   (a)   In the event the public nuisance is not abated by the date set forth in the notice, or, if an extension date has been given by the Manager or by the Board of Building Appeals, then by such date, the owner and occupant shall be guilty of a minor misdemeanor and each day of nonabatement shall constitute another offense. If the owner or occupant has previously received notice of a violation of Section 1305.02(a) or 1305.06 within the same calendar year, a subsequent violation of the same section is a minor misdemeanor without further notice as provided in Sections 1305.03(e) and 1305.06(c), and each day of nonabatement after the owner or occupant receives a summons or other notice of the violation is another offense.

   (b)   The Manager may proceed to have the nuisance abated and the total cost shall be collected by either a civil suit or certification of such total cost to the County Auditor for placement upon the tax duplicate.
   (c)   The Manager may enforce this chapter by injunction brought in the Court of Common Pleas of Williams County. (Ord. 1033. Passed 10-9-95.)
