CHAPTER 32: POLICE DEPARTMENT

§ 32.01 CREATION; MEMBERS.
   (A)   By virtue of the power granted in R.C. § 715.05, there is created a police department to be known as "The Police Department of Montgomery, Ohio."
   (B)   The Department shall be under the control and shall be directly responsible to the City Manager and shall consist of the following:
      (1)   The Chief of Police.
      (2)   As many lieutenants as are from time to time determined by Council.
      (3)   As many sergeants as are from time to time determined by Council.
      (4)   As many patrolmen as are from time to time determined by Council.
      (5)   Also such other special patrolmen as are from time to time determined for special call or for part-time work as and when directed by the Chief of Police or the City Manager or the Mayor.

§ 32.02 ACTION OUTSIDE TERRITORIAL LIMITS.
   Any action taken by any member of the Police Department, outside the territorial limits of the municipality, if taken in pursuance of any police matter involving the municipality, or if taken in the line of cooperation upon official police business with any of the other governmental units of Hamilton County, Ohio, or if taken under the authority of a Mutual Assistance Agreement, which action is ordered or approved by the Chief of Police of the municipality, or other supervisory officer, or if done upon an emergency basis, is subsequently ratified by the Chief of Police, shall be considered to be an action performed in the course of his employment by the member of the Police Department.
