§ 73.42 ATV, UTV, AND SNOWMOBILE REGULATIONS.
   (A)   ATVs, UTVs and snowmobiles shall be allowed to ride on the right shoulder of all town roads or, if not possible, in the normal flow of traffic on the roadway; provided, however, snowmobiles shall ride on the roads of the town only for the purpose of obtaining essential services, such as gas, food, medicine or for emergency purposes. ATV, UTV and snowmobile traffic will yield the right-of-way to vehicular traffic in all directions and shall comply with all posted speed limits, but shall not exceed 45 mph.
   (B)   ATVs, UTVs, and snowmobiles shall run with headlights and taillights switched on and in good operation at all times. ATVs and UTVs may be equipped with directional lights, which may be utilized when making a turn. Operators of ATVs, UTVs and snowmobiles shall utilize hand signals when making a turn.
   (C)   Drivers must be 18 years of age and must have a valid driver's license.
   (D)   The operator and any passenger of a snowmobile shall be required to wear a safety helmet which meets current state requirements for motorcycle riders.
   (E)   The town makes no representations as to the safety of its roadways or the use of its roadways for ATV, UTV and snowmobiling purposes. All operation of ATVs, UTVs and snowmobiles is undertaken at the risk of the operator and his or her passengers. All ATVs, UTVs and snowmobiles shall only carry the maximum number of occupants in which that unit intended to accommodate.
