ADOPTING ORDINANCE
ORDINANCE NO. 529
AN ORDINANCE, APPROVING, ADOPTING, AND ENACTING AMERICAN LEGAL PUBLISHING CO.'S, INDIANA BASIC CODE AS THE CODIFIED ORDINANCES OF THE TOWN OF MONROEVILLE.
WHEREAS, The present general and permanent ordinances of the Town are inadequately arranged and classified and are insufficient in form and substance for the complete preservation of the public peace, health, safety, and welfare of the Town and for the proper conduct of its affairs; and
WHEREAS, the Acts of the General Assembly of the State of Indiana empower and authorize the Board of Trustees of every Town to revise, amend, restate, codify and to compile any existing ordinance or ordinances and all new ordinances not heretofore adopted or published and to incorporate said ordinances into one ordinance in book form; and
WHEREAS, the American Legal Publishing Co. publishes a code of ordinances suitable for adoption by Towns in Indiana;
NOW, THEREFORE, BE IT ORDAINED by the Board of Trustees of the Town of Monroeville, Indiana, that:
Section 1. American Legal Publishing Co.'s Indiana Basic Code, as reviewed and approved by the Board of Trustees, is adopted and enacted.
Section 2. A summary of the subjects contained in the Indiana Basic Code, as adopted, is as follows:
TITLE I: GENERAL PROVISIONS
Chapter 10. General Provisions. This chapter contains general provisions and rules of construction that are operative throughout the Code.
Chapter 11. Ordinances Repealed and Saved. This chapter lists ordinances of the Town specifically saved and those specifically repealed by adoption of the Code.
TITLE III: ADMINISTRATION
Chapter 30. Board of Trustees. This chapter contains provisions of state law dealing with the Board of Trustees, the President of the Board of Trustees, the division of executive and legislative powers and duties generally, and the passage of ordinances.
Chapter 31. Officers and Employees. This chapter contains provisions of state law dealing with Town officers and employees.
Chapter 32. Finance and Revenue. This chapter contains provisions of state law dealing with municipal financial administration.
TITLE V: PUBLIC WORKS
Chapter 50. Sewage System. This chapter contains provisions governing the sewage disposal system in the Town of Monroeville.
Chapter 51. Waterworks System. This chapter contains provisions governing the waterworks system in the Town of Monroeville.
TITLE VII: TRAFFIC CODE
Chapter 70. General Provisions. This chapter contains provisions applicable to the entire title and provisions dealing with traffic-control devices.
Chapter 71. Traffic Rules. This chapter contains provisions governing the operation of vehicles, as well as provisions concerning parades.
Chapter 72. Parking Regulations. This chapter contains provisions governing the parking of vehicles and snow emergencies.
Chapter 73. Bicycles. This chapter contains provisions governing the operation of bicycles, snowmobiles and off-the-road vehicles.
Chapter 74. Traffic Schedules. This chapter designates speed limits and traffic signs.
Chapter 75. Parking Schedules. This chapter includes provisions governing vehicle parking.
TITLE IX: GENERAL REGULATIONS
Chapter 90. Animals. this chapter contains provisions dealing with the control and treatment of animals in general; and the control, treatment, and licensing of dogs in particular.
Chapter 91. Fire Prevention. This chapter contains regulations dealing with fire prevention.
Chapter 92. Littering and Posting Notices. This chapter contains regulations dealing with littering, hauling loose materials, and posting notices.
Chapter 93. Nuisances. This chapter contains provisions governing conditions which constitute nuisances and the procedure for abatement of nuisances.
Chapter 94. Streets and Sidewalks. This chapter contains provisions governing streets and sidewalks in the areas of excavations, construction, and obstructions.
TITLE XI: BUSINESS REGULATIONS
Chapter 110. Auctioneers, Peddlers, and Transient Merchants. This chapter contains provisions dealing with the licensing and regulation of auctioneers, peddlers and transient merchants.
TITLE XIII: GENERAL OFFENSES
Chapter 130. General Offenses. This chapter contains offenses not dealt with elsewhere in the code.
Chapter 131. Offenses Against Property. This chapter contains provisions prohibiting trespassing, injury and vandalism.
Chapter 132. Offenses against Public Morals. This chapter prohibits indecent performances.
Chapter 133. Offenses against Public Order. This chapter prohibits loitering, vagrancy, issuing false alarms, disturbing the peace and, unauthorized discharge of firearms.
TITLE XV: LAND USAGE
Chapter 150. Safe Building Code. This chapter adopts and implements provisions of the Indiana Code regarding safe buildings and regulates the use of scaffolds.
Chapter 151. Planning and Zoning. This chapter designates the Allen County Plan Commission and staff of that body as implementers of planning and zoning in the Town of Monroeville.
TABLE OF SPECIAL ORDINANCES
The table of Special Ordinances contains tables which set forth acceptances, annexations, dedications, franchises, street name changes and vacations.
Section 3. A copy of the Indiana Basic Code, as adopted, shall accompany this ordinance and shall be made a part of the permanent records of the Town.
Section 4. All prior ordinances specifically applying to the subjects treated in said Code other than Planning and Zoning and Subdivision Control shall be deemed repealed from the effective date of said Code except as they are included and reordained in whole or in part in said Code; provided such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of said Code, nor shall such repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises or granting special rights to the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plats or dedication of land to public use naming or vacating or setting the boundaries of streets, alleys or other public places, nor to any other ordinance of a temporary or special nature or pertaining to subjects not contained therein.
Section 5. Said Code shall be deemed published as of the day of its adoption and approval by the President of the Board of Trustees, and the Clerk-Treasurer of the Town of Monroeville is hereby authorized and ordered to file a copy of said Code in the Office of the Clerk-/Treasurer.
Section 6. Said Code shall be in full force and effect two weeks from the date of its publication and filing thereof in the Office of the Clerk- Treasurer. Said Code shall be presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties, and regulations therein contained and of the date of passage, and that the same is properly signed, attested, recorded and approved and that any public hearings and notices thereof as required by law have been given.
