§ 94.06 SIDEWALK CONSTRUCTION.
   (A)   All owners of real estate within the corporate limits of the town shall, at their own expense, be responsible for constructing, restoring, repairing and maintaining in an attractive, safe condition, all sidewalks that abut and/or pass next to or across part of their property, hereinafter “Responsible Owner.”
   (B)   Responsible Owner shall repair and maintain sidewalks as needed but no later than 90 days after written notification from the President of the Town Council. Responsible Owner shall construct new sidewalks (where none have been before) within 90 days after written notification from the President of the Town Council and shall replace sidewalk that has been removed within 30 days after the President’s written notification.
   (C)   Notwithstanding, and in addition to, any penalty that may be assessed pursuant to § 94.99, if Responsible Owner fails to maintain, repair, replace or restore sidewalks within the time set forth in subsection (B), the town may undertake such construction, repair, maintenance, replacement and restoration and may charge Responsible Owner all costs of such work, including labor costs, even if town employees perform such work.
   (D)   All sidewalks hereafter constructed or laid within the corporate limits of the town shall be built or constructed of cement, shall be 48 inches in width, shall have a minimum thickness of five inches, and shall have a minimum foundation of six inches of sand.
   (E)   Unless a written deviation is obtained from the President of the Town Council, all sidewalks hereafter constructed or laid within the corporate limits of the town shall be built next to the street which abuts the property line, shall be built within one foot from the property line, and shall connect to the sidewalks of adjacent Responsible Owners.
   (F)   No sidewalk shall be constructed, laid, or restored within the corporate limits of the town until prior approval thereof shall have been first obtained from the President of the Town Council. All parties have the right to appeal any decision to the full board within 30 days. The appeal must be in writing.
