(A) It shall be the duty of every owner or occupant of any dwelling house, building, or structure of any kind or description whatsoever, and of any lot or parcel of real estate, to remove or cause to be removed from such dwelling house, building, structure, lot, or parcel of real estate, all ashes, waste, unwholesome materials, and impure substances of every kind and description.
(B) Upon failure of any such person to remove or cause to be removed any such ashes, waste, unwholesome material or impure substances, the police officer is hereby authorized to order the same to be removed from such dwelling house, building, structure, lot, or parcel of any real estate, and if the same is not removed by such person within five hours after notice on that person, to cause the removal thereof at the expense of that person, or the person who may be in charge of such building, dwelling house, structure, lot, or parcel of real estate, or in lieu of such notice may immediately issue a citation for a fine to the owner, occupant, or person in charge.
(C) If the owner or occupant or person in charge of the premises cannot be found for the purpose of notice, the police officer of the town can cause all such waste, ashes, unwholesome materials, and impure substances to be removed to some suitable place at the expense of the owner, occupant, or person in charge. It shall also be the duty of every owner, or occupant, and person in charge, to cause all dwelling places, buildings, structures, cellars, privies, rooms, halls, and any outbuildings to be kept and maintained at all time in such order and condition so that the same shall not be foul, unhealthful, or unhealthy or sufficiently noisy that the noise can be heard on any other owner's property.
